How does a noncompete agreement work?
I am an employee at a small business and I have recently been asked to sign a noncompete agreement. I am not sure how these agreements work and what rights I have as an employee. I am also concerned about the restrictions that could be placed on me if I sign the agreement. I want to make sure I understand the implications of signing the agreement before I do so.

In its simplest terms, a noncompete agreement in an employment context is an agreement that says you will not compete with your former employer if you ever stop working for them. It typically forbids things like: + Working for a competitor + Starting a company that sells the same services/products as your employer + Recruiting employees from your current employer after you have left that employment. One thought is that this could be requested shortly before letting an employee go just to protect the company from competition but I hope that is not the case here as it seems like an unfair use of the noncompete agreement ability in Georgia. The issues are usually the geographical scope (for example within 15 miles of Dalton, Georgia), the time period (one or two years is usually sufficient and courts do not favor long noncompete agreements), and the consideration (such as a new job - which is not applicable in your case, or more compensation). I recently left my job and I was given a severance package that included a Employee Separation Agreement. I am trying to understand what my rights are in regards to continuing my health insurance coverage under COBRA. I am trying to determine if my former employer will pay for any of my COBRA premiums and if I am eligible for any additional benefits under the Employee Separation Agreement.

The opportunity to continue benefits after the termination of an employment relationship is required under COBRA if your employer has 20 or more employees. COBRA further requires that notice must be sent to former qualified employees with instructions on how the former employee can elect to participate in such benefits, the deadlines for making such an election, and the cost of making the election to continue benefits. Unless the separation agreement provides specifically for the payment of the COBRA premium, the cost of continuing benefits is going to be the sole responsibility of the former employee and those premiums must be made in the time periods specified.

Employment handbook overtime policy?
I recently accepted a new position with a company and was given an employee handbook to review. I was looking over the overtime policy and noticed that it does not appear to be in compliance with the federal and state laws. I am concerned that the policy could leave me in a difficult position if I were to ever be asked to work overtime, so I am looking for advice and guidance from a lawyer to determine if the policy is legally binding.

I am concerned about the geographic scope of the agreement and need to understand what areas it would cover, and if it would prevent me from taking a position with a competitor in another state or country.

The Courts use a reasonableness standard determine if a non-compete is reasonable in time and geographic scope. It would be necessary to see the non-compete to tell you what it says, the areas it would cover and if it would prevent you from taking another position.

Are there caps on damages in settlement agreements?
I am a small business owner who is in the process of settling a dispute with a former employee. The employee is claiming a certain amount of damages, which I believe is excessive. I am interested in finding out if there are any caps on damages that can be included in a settlement agreement, as I would like to come to an agreement that is fair and reasonable for both parties.

In Washington, there are no punitive damages. Employment resolutions are usually based on some percentage or multiple of a person's salary. It is your job to reach a settlement that is fair and reasonable for you, not for a litigant against you (that's their job, not yours). If you are having difficulty resolving this dispute, you may want to consider mediation. Before you pay the employee, be sure to have them sign a full and complete release of all current and future liability and claims against you individually, your business, your heirs; etc. Also, if you have business insurance, it's possible you are entitled to a free attorney to represent you in this dispute.
