Yes, it is possible. Remember opportunities with employers should be mutually beneficial. Ultimately, you will receive an offer from the employer that you negotiate. In all negotiations, negotiate confidently and reasonably. It is ok to walk away from an offer if it does not meet you expectations.

Can a JV own property?
I am currently in talks with another company to form a joint venture (JV) for a real estate development project. We are planning to pool our resources together to purchase land and build properties. However, I am uncertain if a JV can legally own property or if we would need to form a separate legal entity for the ownership of the real estate. A joint venture can own property. It's a type of partnership. But in a partnership, each partner is liable for anything the other partner does. You would be much better off setting up as an LLC. What is fixed term employment contract?
I have been given a contract that says 'Fixed Term Employment Contract'. How is this different than a normal employment contract? Is there anything I need to consider before signing this?

Generally a fix term employment contract differs from a genera employment contract in that it has an end date. For example, at-will contracts continue until you are fired or quit, while a fixed term contract only continues until the term expires. The main points to look at would be what they are classifying you as (employee vs contractor), the length of the term (so you know when the contract is up), and how to renew the contract or if there is an automatic renewal. It would also be good to double check the contract for termination clauses, as quitting may be more complicated under a fixed term contract. Ultimately, as with all contract matters it’s probably best to reach out to an attorney to review the document to get more specific answers to your concerns.

Is a liability waiver binding on heirs?
I recently inherited a business from a family member and I am looking to create a liability waiver for the business. I want to make sure that the waiver is binding on the heirs of the business in the event that the business is passed down. I want to make sure that any potential liabilities are not passed on to future generations of the family.

A liability waiver can indeed be binding on heirs if the language of the waiver expressly includes heirs or assigns. However, the binding nature of a waiver on heirs could be affected by several factors. Administrative regulations such as 1 TAC § 373.209 and statutes like V.T.C.A., Civil Practice & Remedies Code § 71.021 and V.T.C.A., Special Districts Code § 8502.020 stipulate conditions under which heirs can assert claims, which could potentially affect the binding nature of a waiver on heirs. Finally, the enforceability of such waivers can be influenced by whether the instrument is recorded or not, as per V.T.C.A., Property Code § 13.001. In summary, while a liability waiver can be binding on heirs, the enforceability of such waivers can be influenced by various factors, including the specific language of the waiver, the termination of the contract, administrative regulations or statutes, and whether the instrument is recorded or not. I recommend having a discussion with an attorney and have them draft the language to achieve your goal.
