How To Get an Addendum to a Lease as a Tenant

I'm a tenant with a Case & Associates Property looking to get an addendum made to a lease agreement, specifically about a possible error with the lease term that was signed on. Is this something that can be done between a tenant and property manager? Do I need a tenant lawyer involved? Honestly any help with how to proceed on this is greatly appreciated. The error is that I had wanted to sign on for three months, but got put on for fourth months instead. I believe an addendum could correct this, but am not sure.

You're basically asking for free legal advice because you're not asking for a drafted document but I'll bite because no local lawyer will have a remedy for this anyway. The LL tenant laws for Oklahoma are found in Title 41 of the Oklahoma Statutes. They are very loose. Your proposal could be done, but the PM would have to agree to it. Typically when contracts are altered, there must be a new form of consideration in exchange for the alteration/addendum (unless you're being put on federal military orders which can break any lease.) If you're not going to offer them something of value (i.e. more money, guaranteed professional cleaning of the apt, etc.) they will not have a reason to sign it. If the language of the lease clearly stated 4 months and you signed it anyway, that is on you and you're out of luck. "I wanted to sign on for 3 months but got put on for 4 months instead." Who signed your name without your consent? Were you fraudulently coerced into signing for 1 more month....It sounds like you signed for 4 hoping you could get them down to 3 later...

Are rental agreement templates reliable?

I recently signed a rental agreement that I found online. I was told that it was a legally binding document, but I am concerned that it may not be reliable because it was not drafted by a lawyer. I would like to know if rental agreement templates are reliable or if I should have the agreement reviewed by a lawyer.

A Washington State residential landlord/tenant template may or may not be reliable depending on who drafted it or provided it, whether or not it applies to a particular situation, and whether it is up to date (in 2023, WA State made several changes to the law). You can review the state law here: https://apps.leg.wa.gov/rcw/default.aspx?cite=59.18 However, some cities/counties have additional requirements and/or provisions that also must be followed. It would have been a good idea to have an attorney review the document BEFORE you signed it.

How to draft a fair rental agreement?

I recently moved to a new city and am looking to rent an apartment. North Carolina General Statute 42 contains the North Carolina Residential Rental Act i.e. the landlord-tenant law. Generally, North Carolina landlord-tenant law requires that (1) a residential landlord keeps the property fit and habitable and (2) a residential tenant keeps the property safe and sanitary, pays the rental fee at the time and in the amount agreed upon, and follows (valid) agreed-upon rules. It also addresses other important issues like security deposit, late fee, required notice, termination, and eviction. One important aspect of the statute is that it does not allow a residential landlord to avoid or disclaim certain responsibilities simply by having a tenant agree in a rental agreement. Another important aspect of the statute is that it allows a residential tenant to recover money from a landlord who engages in certain particularly egregious conduct. It is important for a future residential tenant to know each party's rights and responsibilities before entering into a residential rental agreement. If you are considering signing a North Carolina residential lease, you are entitled to have an attorney review it and advise you before you sign.

A residential lease agreement is sometimes referred to as a "residential rental agreement," a "rental agreement," a "residential lease," a "lease agreement," or simply a "lease." It is a legal contract between a landlord and a tenant that details the terms and conditions of the tenancy, including the rights and responsibilities of each party. Every U.S. state has laws regarding the rights and responsibilities of residential landlords and tenants. For example, North Carolina's "Residential Rental Agreement Act" can be found in Chapter 42 of the North Carolina General Statutes. Generally, a residential tenant has the right to possess (or occupy) the property, the right to quiet (or peaceful) enjoyment of the property, and the right to the property being fit and habitable. In exchange, a residential tenant is responsible for paying a rental fee (in full and when due), not damaging the property, and keeping the property safe and sanitary. However, a residential lease agreement may grant additional rights to and/or impose additional responsibilities upon a tenant, so long as neither conflict with the law. For example, a landlord might provide a tenant access to a business center, a clubhouse, or an exercise room but might charge a fee for said access. For another example, one landlord may prohibit pets, one may allow pets but charge no fee, and another may allow pets and charge a fee. Last, not everything stated in a residential lease agreement is necessarily enforceable. Having an attorney review a lease before signing it can help clarify the rights and responsibilities of the landlord and the tenant, which can also help avoid confusion and conflict later on.
