How does a noncompete agreement work?

I am an employee at a small business and I have recently been asked to sign a noncompete agreement. I am not sure how these agreements work and what rights I have as an employee. I am also concerned about the restrictions that could be placed on me if I sign the agreement. I want to make sure I understand the implications of signing the agreement before I do so.

In its simplest terms, a noncompete agreement in an employment context is an agreement that says you will not compete with your former employer if you ever stop working for them. It typically forbids things like: + Working for a competitor + Starting a company that sells the same services/products as your employer + Recruiting employees from your current employer after you have left that employment. One thought is that this could be requested shortly before letting an employee go just to protect the company from competition but I hope that is not the case here as it seems like an unfair use of the noncompete agreement ability in Georgia. The issues are usually the geographical scope (for example within 15 miles of Dalton, Georgia), the time period (one or two years is usually sufficient and courts do not favor long noncompete agreements), and the consideration (such as a new job - which is not applicable in your case, or more compensation). Employee separation agreement non-compete clauses?

I recently left my job, and my former employer presented me with an Employee Separation Agreement, which includes a non-compete clause. I am concerned about the implications of signing such an agreement and would like to know what my rights are in regards to this clause. I am worried that signing this agreement could limit my future job prospects.

Depending on the scope of the non-compete clause, it could substantially limit your future job prospects. Is the non-compete limited: in time? In industry? In geographical area? To certain competitors? You can certainly negotiate the scope of the clause with your former employer so that your ability to find a similar job is not too restricted. If your employer insists upon a non-compete that is too strict, you should consider whether the severance amount being offered is worth the loss of freedom for your future job hunt.

Generally, in Florida, severance is a gift. $1 of severance is usually $1 more than an employer is obligated to provide. An offer of severance may be required if an employee has an employment agreement providing for severance or is otherwise subject to a collective bargaining agreement that provides for severance. Severance agreements that are only offered to certain employees in a discriminatory manner (such as based on age, religion, national origin, sex, etc) may be a violation of local, state and/or federal law.

My friend owns a Company in UK that shares a profit agreement to a limated liability company in Delaware, if they were to terminate there contract and the non competee they are stating i must shut down my buisiness for 6 months legal?

The answer depends largely on two factors: 1) what documentation did you sign that had non-compete language and 2) whether the non-compete is enforceable. Many states are trending towards non-enforceability of non-competes, depending on how burdensome they are on the person.

There is no requirement under California law that a company pay severance to a terminated employee. Your severance pay will be controlled by either your employment agreement or employee handbook. However there are certain things, like paying you your final paycheck immediately that your company will be required to do under California law.
