Should I cover updates in my terms of service?
I am the owner of an online retail business that sells products and services to customers. I am in the process of creating a terms of service agreement for my business and I am wondering if I should include language that would cover updates to the terms of service in the future. I want to make sure that I am protecting my business and customers from any potential issues that may arise due to changes in the terms of service.

Yes. There are at least two ways to do this. The better method is to send amendments to the TOS to all clients, and have them agree to each amendment if and when it arises. The poorer method is to simply refer to any future amendments when the client first signs the TOS as being incorporated automatically; I don't think that's a good idea.

I am a physician looking to enter into an employment agreement with a hospital. I am currently in the process of negotiating terms of the agreement, and am considering the possibility of signing a digital version of the agreement. I want to know if this is legally permissible, and if there are any potential risks or considerations associated with signing a digital agreement.

The federal ESIGN Act, passed in 2000, gives full force and effect to digital signatures with the same weight as "wet" signatures. However, you should discuss this with an Attorney for your specific agreement if you are concerned. An Attorney can research your specific industry, regulations, and state statutes that may impact digital signatures or have specific requirements around digital signatures that are different from other documents.

I sold my business in 9-2016 for $300,000 at 6% interest and received $4500 a month for payments then in January 2020 lowered the payments to $3000. How long until the note is paid off? Also the buyers now think they paid too much and want to change the amount, can they so that?

Hello, Everything will depend on what your contract states. If the agreement said they paid the amount they did, it would not matter if they now think otherwise but it depends on your agreement. How to amend a contractor agreement?
I am a small business owner who recently signed a contractor agreement with an independent contractor. After signing, I realized I need to make a few changes to the agreement due to changes in the scope of work. I need to know how to amend the agreement so that the changes can be legally binding.

Amending a contract, including an independent contractor agreement, usually takes three main steps: First, to amend a contract, the parties must usually agree to new terms. This sometimes requires the parties to negotiate. Second, when the parties to an agreement memorialize it in a written contract, they typically must also sign a written document to amend it. This means that they will need to draft an amendment that accurately reflects the proposed amendment(s). Third, once the parties have drafted an amendment that they are comfortable with, each will sign and will usually receive a signed copy of the fully executed contract amendment. However, note that amending some contracts can be much more complex. For assistance with negotiating or drafting a contract amendment, including for an independent contractor agreement, you should contact a knowledgeable attorney practicing in the appropriate jurisdiction.
