Employment Agreement

My wife & I thought we had a contract from her employer to buy A dental practice after working for them for three years. We now were forced to sign a contract with the people that bought him out to continue working for them so they can get 10x EBITA when they sell shortly. Do we have a case for lost wages?
We moved from 30 miles away because we were told if we worked for 3 years we could buy it for $525,000. They now want $2.5M.
Melissa L.
The first question is do you have a fully executed written contract? This is the first step to determine the terms and conditions such as your wages if there is a breach of contract, the dentist being able to assign the contract and if it can be modified.

Employment handbook vacation policy?
I recently accepted a new job and was given an employee handbook to read over. I read the policies regarding vacation time, but I am unclear about how exactly the policy works and what the process is for taking a vacation. I want to make sure I understand the policy correctly and that I am following the correct procedure for requesting vacation time.
Merry A.
Hello - I am a Washington State employment law attorney. It can often be difficult to understand a policy in an employee handbook. I would suggest two things: (1) Do not ask about the policy or how to interpret it until you have completed at least two months on the job - wait until your supervisor and coworkers get to know you; most likely, you are not eligible for vacation leave until you have been on the job for several months anyway. (2) After two months, ask your supervisor about the policy - not HR. Your supervisor is most likely the person who will have to approve your leave, and he or she will appreciate that you went to him or her instead of going to HR.

Noncompete agreement and public policy?
I recently accepted a job offer with a new employer who asked me to sign a noncompete agreement. I am concerned that the agreement may not be in line with public policy and wanted to get a professional opinion from a lawyer to make sure I am not putting myself in a difficult situation.
Merry A.
If you are in Washington State, where I'm licensed, as opposed to D.C., please let me know what kind of help you are looking for - have you already signed the agreement? I've been a WA State attorney for nearly 38 years, and specialize in employment law.

Employee Separation Agreement

Are employee separation agreements required?
I recently left my job after two years of employment and my former employer has asked me to sign a separation agreement. I am unsure if I am legally obligated to sign this agreement or if employee separation agreements are required by law. I am hesitant to sign the agreement until I have a better understanding of my rights and obligations.
Gagandeep K.
When an employee leaves a company, an employer can offer severance agreement/separation agreement/termination agreement, where employer offers a severance package to the employee (e.g., lump sum money, extended benefits) in exchange for limiting their liability (e.g., release of certain legal claims, confidentiality provisions). An employee can decide whether to accept the severance agreement as-is, whether to negotiate for more favorable terms or to reject the offer. You may consult an attorney to review the severance agreement to understand your rights, obligations, the benefit you are receiving, and the claims you are waiving.

What's probationary period in an employment contract?
I am a recent college graduate who recently accepted a job offer from a company. As part of the offer, I was asked to sign an employment contract. I understand that the contract includes a probationary period, but I'm not sure what that entails. I would like to know what the probationary period is and what it means for me as an employee.
Diane D.
A period of time to evaluate you and to show that you're a good fit for the job and that you are fully qualified for it. At the end of the probationary period, they will either keep you on or terminate you.

View Trustpilot ReviewContracts Counsel was incredibly helpful and easy to use. I submitted a project for a lawyer's help within a day I had received over 6 proposals from qualified lawyers. I submitted a bid that works best for my business and we went forward with the project.
