We now were forced to sign a contract with the people that bought him out to continue working for them so they can get 10x EBITA when they sell shortly. Do we have a case for lost wages?

Is background check part of the employment offer?
I recently accepted a job offer and the employer requested that I submit to a background check. However, I am concerned that I may not have been sufficiently informed that this was part of the employment offer. I am wondering if I am obligated to submit to a background check and if it is a requirement of the offer.

Potential employers are not explicitly required to disclose that a background check is a necessary condition of employment. In certain circumstances, employers must conduct background checks and keep records of these checks. This is exemplified in the Texas Administrative Code, where an employer must maintain written documentation of a pre-employment check for at least two years regardless of the subsequent employment status of the applicant. You may want to check your offer letter for terms that indicate your employment is contingent upon meeting satisfactory requirements in lieu of specific language of "background check". Depending on the industry and or the company, they may be required to do a background check to verify licensing or education in order to mitigate their risks of negligent hiring.

I recently accepted a new position with a company that has requested that I sign a noncompete agreement. I understand the agreement and the limitations it puts on me, but I am concerned about how the agreement would be affected if the company is sold or changes ownership in the future. I would like to understand my legal rights in the event of a change of control.

If the future company buys the equity of your current employer, the Non-Compete continues in effect. If the future company buys the assets, the Non-Compete is terminated. I would request a sentence be added to the effect that "if there is a change of control of the Company (meaning more than 50% of the equity interest or 50% of the voting equity control) is sold or transferred, then this Non-Compete Agreement is terminated.

I recently accepted a promotion within my company and was asked to sign a noncompete agreement. I am concerned that if I accept the promotion and then leave the company, that I will not be able to take a similar position with another company. I am also worried that if I don't accept the promotion, I may be at risk of being terminated. I need to know what my rights are and what the implications are of signing the noncompete agreement.

What's paid time off in an employment contract?
I am a recent college graduate and I am in the process of negotiating an employment contract with a large company. I am trying to make sure I understand the terms of the contract, including the paid time off that is offered. I am hoping to get a better understanding of what's included in the paid time off section of the contract so I can make an informed decision about the offer.

Paid Time Off (PTO) is essentially days (or even hours) that the employee is not required to work but the employer still pays the employee for those hours. It can be awarded in a lump sum in advance, or earned and accumulated over time, dependent on the terms of the employment agreement. PTO may be granted in addition to or in lieu of vacation days, sick days, etc, again depending on the unique employment agreement.
