I have approximately 15 years of attorney practice in IL and MI, doing both transactional and litigation work. I am currently licensed in MI and will be taking the CO bar in February. I am open to discussing paralegal or law clerk positions as I've not practiced law full-time since 2015. I worked as a residential realtor from 2015 until I moved to CO in 2021. I took the UBE in July 2023. I am qualified to become licensed in Utah, New Mexico, Oklahoma and Indiana. I missed the mark for CO by 5 points. I should be licensed to practice law in CO by April 2024.

Power of Attorney

Michigan

Asked on Sep 7, 2021

How can wife get power attorney from sibling for mother?

My wife is trying to get power of attorney for her mom from her sister that only wants her money and now we have her mom and her sister is keeping her I’d and birth certificate so she has no control of her money gave her a bank card with no pin and no I’d so she can’t go to the bank and get her money

George B.

Answered Sep 8, 2021

Generally, if a person is competent, he or she can revoke a power of attorney at any time and execute a new one in favor of someone else. Every individual/business that is aware of the previous power of attorney will need to be notified that it has been revoked and given the updated power of attorney. However, if a person has any conditions that may be impairing mental functions, it may be necessary to petition the court for guardianship/conservatorship. Both of these scenarios can get complicated incredibly fast, and you should consult with a lawyer in either situation.

Employment Contract

Florida

Asked on Apr 12, 2023

What's vacation time in an employment contract?

I recently accepted a new job and I was provided an employment contract to review. In the contract, there is a section about vacation time, but it is not very clear. I'm trying to understand what vacation time is included in the contract and what the expectations are for taking time off. I want to make sure I have a clear understanding of my rights and responsibilities regarding vacation time before I sign the contract.

You can create your own will. However, having an attorney draft it for you will ensure that your wishes are carried out in all circumstances. Doing it yourself without having any experience may cause many problems after your demise.

Durable Power of Attorney

Colorado

Asked on Nov 5, 2021

How does a durable power of attorney work when the person dies?

If you have a durable power of attorney and the person dies, do you still have the authority or does it go to the spouse. I have a durable power of attorney for my aunt, she just died and I'm trying to take care of her funeral and things. Does her husband now have the right to make decisions or myself with the durable power of attorney?

Sarah D.

Answered Nov 30, 2021

A Durable Power of attorney for finances (and healthcare) expires once your aunt dies. It is the executor of her will who now acts in that stead related to her finances. If the executor is the spouse, it will be his right to make the decisions. However, if all property was jointly owned between spouses, there is no need to probate the will under Colorado law.

Prenuptial Agreement

Massachusetts

Asked on Apr 21, 2023

How does a prenuptial agreement affect estate planning?

I am getting married soon and I am interested in understanding how a prenuptial agreement would affect my estate planning. I would like to know what steps I should take to ensure that my assets are protected and that my wishes are carried out after I pass away. I am also curious as to how a prenuptial agreement might affect the distribution of my assets to my family members and other beneficiaries.

Briana C.

Answered May 23, 2023

A prenuptial agreement does not create an estate plan. But it can do two things. First, a prenuptial agreement can create a contractual promise on the part of one or both spouses to do something in particular with their estate plan (such as promising to leave the marital home to the surviving spouse, or promising to leave everything they have to the surviving spouse, or promising to set up a trust, etc. etc.). If this contractual promise is broken, the surviving spouse has a contract claim against the estate of the dead spouse. Second, and almost the opposite, in a prenuptial agreement one or both spouses can waive the rights they would otherwise have by statute, thus freeing up the other spouse to do whatever he or she wants with her estate plan. Without a prenuptial agreement, a surviving spouse is entitled by statute to inherit a certain proportion of the estate of the dead spouse (the exact proportion depends on whether or not the dead spouse has a will, and/or has surviving children). The prenuptial agreement can override these statutory rights and provide that the surviving spouse is not entitled to inherit anything from the dead spouse, except for anything the dead spouse may choose to leave the surviving spouse in his or her will.

Trying to become a poa

My uncle needs a power of attorney

Holly T.

Answered Jun 17, 2022

A POA is best done through an attorney to ensure the verifying/interested parties are proper, the agreement includes what the principal wants, the principal is competent in case of a challenge and it's filed properly if necessary, for example if it will be used to transfer property. All persons should have a POA, HCPOA, Advanced Directives and Will. You can also pull the POA form out of the general statutes of NC. The form is included in the law.
