Can I got a nonrefundable deposited back if no contract was signed?
I scheduled a free photography session with this girl. She said she needed $200 in advance that will go towards a package I'll buy when the photos are done. I decided the next day after looking how expensive her packages are that I couldn't afford it. I never signed the contract she sent me but she will not give me the $200 back. Can I get this money back? Am I in the wrong or is she?

What are common pitfalls in contractor agreements?
I am a small business owner looking to hire an independent contractor to help with some of my workload. I am concerned about entering into an agreement with the contractor and would like to know more about common pitfalls in contractor agreements so that I can ensure I am entering into a fair and equitable arrangement.

There are several potential pitfalls that can be mitigated or removed by addressing them in the contract. These include: whether the contract calls itself an independent contractor agreement but yet fails the test for an independent contractor and therefore brings in matters such as workers compensation coverage (depending on number of employees), liability for contractors acts or omissions, unemployment tax, tax withholding v 1099 and several others. These can be eliminated via proper drafting.

Is pricing protected under an NDA?
I am in a negotiation with a vendor and they are trying to get us to sign a mutual NDA because they want to protect their pricing.

The answer depends upon how you define protected or confidential information under your NDA. Even if pricing is included as protected information, often pricing becomes "excluded" from the NDA protection because the "pricing" has been made public to other third parties. You are often better protected by having a pricing methodology and ensuring that such is protected under the NDA.

I need to sue on an unpaid promissory note
The note was written back in March 2019 I hired an attorney and he has done nothing for me! I made tons of requests to try to settle out of court with this man and he just keeps blowing me off

You need someone who will attempt to settle the matter for you and if that fails be prepared to sue on the note and take the necessary action to collect. This assumes the debtor has assets to collect against. It can take a while. I have had some folks pay relatively promptly, others several years. Communication between attorney and client is very important in this process. If you have no idea what is going on in your case you can get very anxious. I make sure you get consulted on each development and you get copies of each filing.

Can a severance agreement be digital?
I recently accepted a voluntary severance package from my employer and have been asked to sign a severance agreement. I am curious if this agreement can be signed digitally, as I am not currently in the same city as my employer. I am looking for advice on the legalities of digital agreements and any potential risks associated with signing a severance agreement digitally.

In 1999 the California Legislature enacted the Uniform Electronic Transactions Act (the “UETA”), Civ. Code, §§ 1633.1 et seq., which provides that when a law requires a record to be in writing or requires a signature, an electronic record or signature satisfies the law. The law requires that any contract entered into between two parties may not be denied legal enforceability simply because of the use of an electronic signature. This has also be upheld in the employment law setting in some case law.
