Can I got a nonrefundable deposited back if no contract was signed?
I scheduled a free photography session with this girl. She said she needed $200 in advance that will go towards a package I'll buy when the photos are done. I decided the next day after looking how expensive her packages are that I couldn't afford it. I never signed the contract she sent me but she will not give me the $200 back. Can I get this money back? Am I in the wrong or is she?

You can draft the agreement with some protections to ensure payment; however, you need to keep in mind that payment will always be contingent on whether they have money to pay or not. Severance agreement and non-disparagement clauses?
I recently left my job and was offered a severance agreement. In the agreement there were two clauses, a non-compete clause and a non-disparagement clause. I am concerned about the implications of these two clauses and how they will impact my future career prospects. I am looking for clarification on the language of the clauses and what I am allowed to do, and not do, once I have signed the agreement.

I am concerned about the “entire agreement” clause in the lease, as I am not sure what it covers and what the implications are for me and my business. This is a contractual provision which aims to prevent the party relying on it from being liable for any statements or representations (including pre-contractual representations) except as expressly set out in the agreement. It generally precludes the introduction of parol evidence or evidences of other agreements that are not in writing.

What are common pitfalls in contractor agreements?
I am a small business owner looking to hire an independent contractor to help with some of my workload. I am concerned about entering into an agreement with the contractor and would like to know more about common pitfalls in contractor agreements so that I can ensure I am entering into a fair and equitable arrangement.

There are several potential pitfalls that can be mitigated or removed by addressing them in the contract. These include: whether the contract calls itself an independent contractor agreement but yet fails the test for an independent contractor and therefore brings in matters such as workers compensation coverage (depending on number of employees), liability for contractors acts or omissions, unemployment tax, tax withholding v 1099 and several others. These can be eliminated via proper drafting.
