Settlement Agreement

How to I get paid from this settlement without having to spend thousands on an attorney
Hello. Through legal help, I have a signed agreement with the other side to pay me $6500 in the settlement, after the other side did not deliver the product i signed on or. Before the attorneys got involved, I wrote a bad review about the 'others sides' business and posted it on the USREVIEW website. In the settlement agreement, i agreed to delete that post (review) however, i cannot. The 'other side' has the ability to have the review deleted, but he refuses to do so, using a stalling tactic not to pay me the settlement. The other side is in the UK. I have already wasted a lot of money on a lawyer from the U.S, he did not help much. I am now working with a lawyer in the UK, however, she is not sure that i will collect, even if we go to trial and win. Do i give up on this settlement, or is there another way to collect on the settlement without having to waste thousands of dollars?
Donya G.
Hello, It depends. Is your settlement court approved? Did you go to court and the court approved it or was it drafted by attorneys only? If it is not court approved, you can seek to have it approved by the court, however, you would need to be able to serve the person who is in the UK. Do they have a US address? will their lawyer accept service? Do they have property in the US? If yes, then you can sue in small claims court in NJ but only for $3,000.00, which is the limit but it is a process you can do by yourself with guidance. Otherwise if you want to sue for the full $6,500.00 your case should be filed in the regular Special Civil Part. Does the party have assets here in the US? you might want to hire an investigator (cheaper than an attorney) to locate any assets. If they do, then with your approved court settlement, you can attach the property or file a lien to get your money back. If you need further assistance, you can contact me on the website for assistance with my services. All the best Donya Gordon

Asset Purchase
California
I am a seller .Buyer broke the contract, How do I get the earnest money in case the buyer did not agree to sign ? .
I am a seller . made a contract to sell the commercial building. But Buyer did not make to fulfill their jobs, my broker asked to sign for the deposit. They did not answer for long time. Escrow company said without both sign, can not release the deposit to the seller.
Donya G.
That is correct. The escrow agreements I have drafted or reviewed would only release the money if both parties agreed. However, the document should outline what happens when there is a dispute. You will need the document reviewed and then advised on the next steps. As a contracts attorney who has experience with contract disputes, I can assist you. If you would like to engage my services, you may contact me on the Contracts Counsel website. Donya Gordon

Arbitration Agreement
Oregon
Does the documents and photos I have enough to go to Arbitration
Contractor didn't do all the jobs he was hired to do and what he did do is unacceptable. For example, the Trex deck he built was improperly installed according to the Trex company and another Contractor. It will need to removed and replaced with the proper material/tools and measurements. Currently it is unsafe.
Donya G.
As an Arbitrator and someone who helps clients during their arbitration, I have learned that your evidence is critical to the success or failure of your case. So it is important to have as much evidence as possible and to notarize things you believe the other side would contest as not being real, true or authentic. If you need further assistance, you can contact me directly through contracts counsel. Donya Gordon

Building Loan Agreement

I brokered a load to a company, they were late , now the office manager wants 4000 $ for a load from a year and 1/2 to be paid, and its a completely differt company. She says the 3 loads wont be delivered til its paid, holding the loads hostage and their is Bulk Mail on the loads, what recourse do I have
I am in loagistics
Donya G.
The recourse you would have is based in your agreement. Would her actions constitute a breach/breaking of the covenants of the original agreement? If so, then your agreement should also lay out the consequences of such breach. You would need to have the contract reviewed so that you can be advised on what your rights and recourse is based on your agreement. As a contracts dispute attorney with litigation and arbitration experience, I can review your agreement and advise you. You can connect with me directly on the Contracts Counsel website or on my page at Donya Gordon. Thanks Donya
