My friend owns a Company in UK that shares a profit agreement to a limated liability company in Delaware, if they were to terminate there contract and the non competee they are stating i must shut down my buisiness for 6 months legal?

The answer depends largely on two factors: 1) what documentation did you sign that had non-compete language and 2) whether the non-compete is enforceable. Many states are trending towards non-enforceability of non-competes, depending on how burdensome they are on the person.

I recently started a new job and my employer provided me with an Employment Handbook. I have read through the handbook and noticed that there is not a section on employee privacy policies. I'm concerned that the lack of an employee privacy policy could leave me vulnerable to having my personal information shared without my knowledge or consent. I am interested to learn what kind of legal protections I may have in this situation.

How are damages outlined in a settlement agreement?
I recently reached a settlement agreement with a former employer in a dispute over unpaid wages. The settlement agreement outlines that I am to receive a certain amount of money as damages, however, I am unclear on how these damages were calculated and if there are any additional costs or fees associated with the settlement agreement. I am hoping to find out more information on how the damages were determined so that I can make sure I am receiving a fair settlement.

Your questions are certainly valid and you are entitled to answers. And you should receive the information before you sign a settlement agreement. Some of the terms of which should be included in the settlement agreement, such as if there are any other fees or costs associated with the settlement.

Employee separation agreement and COBRA benefits?
I recently left my job and I was given a severance package that included a Employee Separation Agreement. I am trying to understand what my rights are in regards to continuing my health insurance coverage under COBRA. I am trying to determine if my former employer will pay for any of my COBRA premiums and if I am eligible for any additional benefits under the Employee Separation Agreement.

The opportunity to continue benefits after the termination of an employment relationship is required under COBRA if your employer has 20 or more employees. COBRA further requires that notice must be sent to former qualified employees with instructions on how the former employee can elect to participate in such benefits, the deadlines for making such an election, and the cost of making the election to continue benefits. Unless the separation agreement provides specifically for the payment of the COBRA premium, the cost of continuing benefits is going to be the sole responsibility of the former employee and those premiums must be made in the time periods specified.

You would be wise to request that an attorney review the proposed employment agreement before you sign. In addition to ensuring that you would have voting rights, there are numerous other terms that should be carefully reviewed, such as non-compete language if and when you leave employment; TRAP language (usually requiring an employee to reimburse the employer if the employee receives training during his or her employment); terms and conditions of employment (such as schedule, work type, and duties); vacation hours; how disputes will be resolved; and, sometimes, future severance.
