My experience includes: - representing high-tech companies (including software, military, manufacturing and computer game companies) in connection with negotiating and drafting (1) toolkit, enterprise, Saas, PaaS and other complex agreements and licenses with companies around the world; (2) joint-venture, sales, publishing and distribution agreements; and (3) general corporate agreements. - 5 years as General Counsel of a software company (and many more years representing it as outside counsel); - 3 years as an associate in the Wall Street law firm of Lord, Day & Lord (then the oldest law firm in New York City practicing under the same name); and - speaking at conferences on legal issues including at the annual Game Developers Conference and Miller Freeman's Digital Video Conference. I am comfortable working in areas where the technology -- and the related law -- are new. My recent work includes working as a contract attorney (extended on a month-by-month basis) as American counsel for a publicly traded Swiss industrial corporation with responsibility for drafting form contracts for its planned "industrial internet of things" digital services. What are inheritance rights for niece and nephew?
My Aunt passed away July 9, 2021 and she had a will. On the will she stated that she wants everything left to my mother whom is deceased as well and executer of estate is my sister.
Jane C.
Does the will have a provision that states who will receive your aunt's assets if your mother predeceased her? If not, I believe the rules of inheritance found in the New York Statute will govern. https://www.nysenate.gov/legislation/laws/EPT/4-1.1. Your sister needs to go to the Probate Court and/or consult an estate attorney.

Need Will or Trust
Married must include both have children from previous marriage.
T. Phillip B.
Hi. I'm not sure I understand your question. Everyone should have a will regardless of whether you have a trust. The question is whether you need a trust. A lot of that has to do with avoiding probate or some other potential uses depending on the goals and needs. But a typical family would use a trust to better organize everything and control distribution while avoiding going through the court process called probate.

How do I exclude a child from my will?
I want to write my will and exclude an estranged son. Can I just have a paragraph stating my son's name and that he is to receive nothing whatsoever from my estate? Should I leave him $1.00? Is there a preferred approach to make sure he can't contest my will and receive anything? We've been estranged for years. Thanks.
Matthew S.
Yes, you could structure your will in that way. You don't even need to leave $1.

Quitclaim Deed

Taxes related to quitclaim deed?
I recently inherited a property from a family member. I was given a quitclaim deed transferring the title from them to me. I am trying to understand my tax liabilities related to this transfer of ownership. I am not sure if there are tax implications that I need to be aware of and I was hoping to get advice from a lawyer on how to proceed.
N'kia N.
A person who inherits property might be subject to taxes. This includes when the person receives a quitclaim deed for the property. However, the person's tax liabilities will ultimately depend in part on the location of the property itself. For legal guidance on the tax implications of inheriting North Carolina property, you might consider consulting with a knowledgeable North Carolina estate and tax planning attorney. Good luck!
