Hello! I hope you are well! If X is contesting a defective or invalid deed, and the quitclaim deed has been recorded for at least five years, then the deed will be considered valid. Under Oklahoma law, an instrument (in your case, the quitclaim deed) that has not been acknowledged or which contains a defective acknowledgment shall be considered valid notwithstanding such omission or defect, and shall not be deemed to impair marketability, provided such instrument has been recorded for a period of not less than five (5) years. 16 O.S. §§ 27a & 39a. That should work assuming your father isn't responsible on any note associated with the property. If there is a mortgage and note, you'll want to talk with the lender first.

seller is a divorced man whose ex lives across street. She turned him in for not permitting a deck. Court applied restraining orders on both. seller had plans drawn and submitted but pandemic hit, He is in financial crisis and has a buyer for home whose bank has agreed to lend . seller has paid all violation fees but county is slow in helping him. he is evacuated from Caldor fire with his other home. Seller needs to due a subordination and let sale happen while county reviews his plans and inspects. Is there anything else he can do? California ..e

Purchase and sale agreement and boundaries?
I am in the process of purchasing a house and the purchase and sale agreement includes the boundaries of the property. I am concerned that the boundaries listed in the agreement do not match the boundaries of the property as shown in the survey, and I would like to know what my legal options are.

Your options should be set forth in your purchase and sale agreement. Most agreements provide for amendment and/or cancellation if issues are discovered and not corrected during the due diligence period or short period of time thereafter PROVIDED the seller has been placed on notice in accordance with the terms of the agreement. Regardless whether the sales agreement is amended, verifying and ensuring that the legal descriptions in the final closing documents contain a references to the survey should suffice.
