We want to transfer land to our children but we want to still get the income and pay taxes until we die what kind of deed is this
We have three children the attorney made it a warranty deed to transfer our land to them but we still want to have the rent and pay the taxes what kind of deed should this be
T. Phillip B.
Depending on the land and business, I'd consider making an LLC for asset protection reasons. Then you could have a trust as the member. If you need to get the property out of your estate, this will dictate what to do with the trust.

How long is a quitclaim deed good for?
Not sure if I am asking the question the right way. We've been asked to file a quitclaim deed.
Melissa L.
A quit claim deed is like a warranty deed for a permanent transfer of ownership to a property after the applicable consideration of payment.

buying a vacant city lot with a quitclaim deed?
hello, i am looking to purchase a vacant city lot in savannah, georgia. it was taken by the city for taxes in 1968 and sold to the current buyers in 1986. seller will only give a quitclaim deed. once i purchase the lot what is the process and cost to get title insurance? regards paul
Meghan T.
Paul, Please, please, please purchase the title insurance before purchasing the lot (if possible). This will protect you in the event of any title defects. It is normal for the owner of a lot to prefer to transfer the property via quitclaim deed, especially if the property was obtained via a tax sale. However, it may be extremely helpful to determine, in advance, if there are any title defects which need to be addressed. Are you under contract to sell the property? Please reach out to me if you have any questions. Thanks, Meghan K Thomas

Purchase And Sale Agreement

Purchase and sale agreement contingencies?
I am in the process of purchasing a home and have received a Purchase and Sale Agreement from the seller. I understand that there are contingencies that must be met in order for the agreement to be valid, but I am unclear on what these contingencies are and how they will affect the agreement. I am hoping to get some insight from a lawyer on what contingencies I should be aware of and how they could affect the agreement.
Myrna L.
Contingencies are conditions provided in the contract that need to be met prior to performance or close of escrow. In Purchase and Sale Agreements, it is usually the buyer who negotiates for contingencies to reduce or eliminate their risks prior to close of escrow. Normally, buyer’s contingencies would include appraisal reports, property inspections, mortgages, title reports or sale of another property. More often than not, sellers do not have contingencies in Purchase and Sale Agreements because they want to sell the property in a timely manner; if seller cannot deliver the property, it may deem the property not available for sale in the first place.

Can the purchase price be negotiated and, if so, how?
I am interested in purchasing a piece of property, and am curious if the purchase price can be negotiated. The seller has listed the property for a price which is slightly above what I am willing to pay, and I would like to know if it is possible to negotiate the price lower. I have had experience in negotiating prices in the past, but am uncertain of the legalities involved in this particular situation.
Thomas L.
Always. The purchase price is an offer. You can always make a counter-offer.
