I absolutely love helping my clients buy their first home, sell their starters, upgrade to their next big adventure, or transition to their next phase of life. The confidence my clients have going into a transaction and through the whole process is one of the most rewarding aspects of practicing this type of law. My very first class in law school was property law, and let me tell you, this was like nothing I’d ever experienced. I remember vividly cracking open that big red book and staring at the pages not having the faintest idea what I was actually reading. Despite those initial scary moments, I grew to love property law. My obsession with real estate law was solidified when I was working in Virginia at a law firm outside DC. I ran the settlement (escrow) department and learned the ins and outs of transactions and the unique needs of the parties. My husband and I bought our first home in Virginia in 2012 and despite being an attorney, there was so much we didn’t know, especially when it came to our HOA and our mortgage. Our real estate agent was a wonderful resource for finding our home and negotiating some of the key terms, but there was something missing in the process. I’ve spent the last 10 years helping those who were in the same situation we were in better understand the process.

I loaned money to a 5013c organization, I want a lawyer to look over the contract, worried about them defaulting on it
I am worried about a 5013c organization defaulting on a promissary note, they do not seem to have their act together, want to have a lawyer look over the promissary note and get advice on what happens if they default on it
Donya G.
Sure. I take it they have not yet signed as yet? You can draft the agreement with some protections to ensure payment; however, you need to keep in mind that payment will always be contingent on whether they have money to pay or not. I am a contracts attorney and if you you would like my services, you can contact me on the contracts counsel website, or post your job on the website and attorneys will respond to your job. Contract Agreement
South Carolina
I sold my house but was never paid
To avoid foreclosure, I spoke with a contractor to flip my house for me. He would pay my mortgage until it sold then pay it off and keep the profit. I walk away with the mortgage company paid, but I was fouled. He isn't paying the mortgage after I signed the contract. I'm concerned he will be able to sell it now himself without the mortgage company ever being paid.
Christopher B.
There are many issues involved in this question. I would need to see the original deed and mortgage on your house plus the contract you signed with the contractor. The original mortgage almost certainly had an acceleration clause stating that if you sold the property, then the full mortgage becomes due. Going after the contractor might be possible but other avenues would more likely be the better route to keep your house from being foreclosed. Will also need to see if your contract gives ownership to the contractor or just the right to sell on your behalf. Lots of additional questions that need documents to give you your options.

Settlement Agreement
California
Can we renegotiate a settlement agreement?
I recently entered into a settlement agreement with the other party in a dispute, but now I believe that the terms of the agreement are no longer fair and equitable. As such, I am looking to renegotiate the agreement. I have attempted to discuss this with the other party, but they have not been receptive to the idea. I am now seeking legal advice to determine if there is any way to renegotiate the agreement and what the best course of action would be.
Joseph M.
If you enter into a binding contract you have to honour the terms unless there was fraud, mistake or misrepresentation as a basis to set aside or renegotiate.

Letter of Intent
Pennsylvania
Letter of intent
I registered a startup clothing boutique in PA and I planned to attend a fashion trade show to purchase from wholesale vendors. Because I am a startup and my business is not up and running I am required to provide a letter of intent for my boutique. How do I go about getting a letter of intent signed by lawyer?
Amy Sue L.
A "letter of intent" is typically not signed by a lawyer, it is signed by two or more parties who intend to enter into a transaction together in the future, but who do not yet have sufficient details regarding the terms of the transaction to enter into a formal agreement. Has the trade show given any additional info / context about this request? - I think your question has not been answered because your use of the term "letter of intent" and "lawyer" in this context is unusual. More information about what you mean by "registered a startup" would also be helpful - if you have formed a company, you should be able to provide a certificate of good standing or other evidence of that formation to the show, which may be sufficient. If you cannot provide that documentation, I wonder if you are also using the term "registered" in another, non-traditional way (from a legal point of view)? Happy to try to help with more info!
