I absolutely love helping my clients buy their first home, sell their starters, upgrade to their next big adventure, or transition to their next phase of life. The confidence my clients have going into a transaction and through the whole process is one of the most rewarding aspects of practicing this type of law. My very first class in law school was property law, and let me tell you, this was like nothing I’d ever experienced. I remember vividly cracking open that big red book and staring at the pages not having the faintest idea what I was actually reading. Despite those initial scary moments, I grew to love property law. My obsession with real estate law was solidified when I was working in Virginia at a law firm outside DC. I ran the settlement (escrow) department and learned the ins and outs of transactions and the unique needs of the parties. My husband and I bought our first home in Virginia in 2012 and despite being an attorney, there was so much we didn’t know, especially when it came to our HOA and our mortgage. Our real estate agent was a wonderful resource for finding our home and negotiating some of the key terms, but there was something missing in the process. I’ve spent the last 10 years helping those who were in the same situation we were in better understand the process.

Noncompete Agreement
California
i work for a employer from illinois ,however i am in california. My contract has non compete clause. will that be enforceable
My employer has placed me in a position thru another vendor. My employer contract with that vendor is ending. So vendor contacted me. However I am in contract with my employer for 1 year contract.
Christopher M.
Short answer: Probably no, non-compete and non-solicitation clauses are not usually enforceable on an employee in California. Long Answer: Regardless of the choice of law provision in your contract, if an enforcement action is brought against you in California, the California courts will dismiss it as it goes against the "public policy of the state" unless your employer can make a really compelling case. Most states respect the stated public policy of other states when deciding matters against their citizens, so even if the case was brought in another states courts your soon to be former employer would probably be powerless to get a judgement enforcing your non-compete.

Physician employment agreement non-solicitation clauses?
I am a physician who is currently in the process of negotiating an employment agreement with a hospital. I am concerned about the non-solicitation clause in the agreement, as I do not want to be restricted from building relationships with my patients should I choose to leave the hospital in the future. I am looking for guidance on how to structure this clause to ensure that I am able to maintain my professional relationships with patients.
Thomas L.
Non-Competes in Connecticut for physicians are limited to 15 miles and one year. In addition, a non-compete agreement is not enforceable if the employment relationship is terminated by the employer without cause, or the agreement is not made in anticipation of, or as part of, a partnership or ownership agreement. Aks your prospective employer if they are aware of Connecticut law, and in particular Conn. Gen Stat. § 20-14p.

Physician employment agreement confidentiality?
I have recently accepted a position as a physician at a new practice and I have been asked to sign an employment agreement. I am interested in understanding what type of confidentiality is required in this agreement, as I do not want to compromise any of the practice's confidential information. I would like to know what the agreement states about confidentiality and what the consequences are for any breach of confidentiality.

This would require a review of the agreement. The typical cost for such a review is $750 but can cost more depending on the complexity of the issues involved.

Severance Agreement
New Hampshire
In florida, 70 employees at my business they lay off 10 and give severance to 8 out of the ten, myself 5 year employee and a 2 month employeee and both are sales others are operation, do have rights to get the same severance?
looking for my severance
Moxie M.
Generally, in Florida, severance is a gift. $1 of severance is usually $1 more than an employer is obligated to provide. An offer of severance may be required if an employee has an employment agreement providing for severance or is otherwise subject to a collective bargaining agreement that provides for severance. Severance agreements that are only offered to certain employees in a discriminatory manner (such as based on age, religion, national origin, sex, etc) may be a violation of local, state and/or federal law.

Can a new employer ask for my last pay stub?
My company was recently sold but the new company kept the employees. Former won’t hand over our pay information. The new company has requested that we hand in our last pay stub.

The National Labor Relations Act prohibits an employer from engaging in retaliation against two (2) or more employees who band together to for mutual aid and protection, including raising concerns about lack of pay details. See link here: https://www.nlrb.gov/about-nlrb/rights-we-protect/the-law/interfering-with-employee-rights-section-7-8a1 If the company has failed to compensate employees for work, it may be a violation of the Fair Labor Standards Act (FLSA) and/or the Florida Minimum Wage Act (if the employer and employee meet coverage requirements). Florida Whistleblower Act, Fla. Stat. 448.102 provides whistleblower protection for employees who are retaliated for raising certain concerns in the workplace: http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0400-0499/0448/Sections/0448.102.html Finally, if employees have an employment agreement providing pay for their employment, they may have a contractual right to those monies at their pay.
