I am an experienced in house counsel and have worked in the pharmaceutical, consumer goods and restaurant industry. I have experience with a variety of agreements, below is a non-exhaustive list of types of agreements I can help with: Supply Agreements Distribution Agreements Manufacture Agreements Service Agreements Employment Agreements Consulting Agreements Commercial and residential lease agreements Non-compete Agreements Confidentiality and Non-Disclosure Agreements Demand Letters Termination notice Notice of breach of contract My experience as in house counsel has exposed me to a wide variety of commercial matters for which I can provide consulting and assistance on. I have advised US, Canadian and International entities on cross-functional matters and have guided them when they are in different countries and jurisdictions as their counterparties. I can provide assistance early on in a business discussion to help guide you and make sure you ask the right questions even before the commercial agreement needs to be negotiated, but if you are ready to put a contract in place I can most definitely help with that too.

Negotiating after a demand letter?
I recently received a demand letter from an individual who claims I owe them money. I am interested in negotiating a settlement outside of court, but am unsure of the best way to go about this. I am looking to get advice from a lawyer on how to proceed in order to reach a mutually beneficial agreement.
Kimm M.
As a general rule, the best approach would be to either send a letter in response that proposes the settlement terms you desire, or to call the individual and negotiate by phone.

Lien
California
My brother paid off the mortgage loan of my parent's home in California in Jan 2021. In return the ownership was transferred to his name. However, in mid 2023 a lien was put on the property for $80K. We had no idea who filed, after talking with my father he told us that could be a judgement for him to pay back for the "zeek reward" scheme that he joined from more than 10 years ago. Is that legal for the lien to be on the property now that my father is not the owner?
The house is an investment property with renters, my father lives in one room and we do have a rental agreement with him. He manages the property since my brother and sister who are the owners of the property are living in different states.
Joseph M.
If the judgment was against your father and not you then you should be able to fight the lien.

Drafting tone in a demand letter?
I recently received a demand letter from a creditor for an unpaid debt. I am unsure of how to respond in a way that is both respectful and firm. I am concerned about the tone of my response and I would like to make sure that it is appropriate and in line with the law.
Merry A.
It is always an excellent idea to (1) Use a polite and professional tone, along the lines of how you would write if your letter could end up in front of a judge some day; (2) Have a friend or family member review your letter with you before you send it; and (3) include all your pertinent contact information. However, I do want to mention that when you write back, if you don't know what the debt is for, you are within your rights to request written verification of what the debt is for - I mention this because there is a popular scam of sending fake debt collection letters to people and causing them all kinds of stress and distress.

Creditor rights in debt settlement agreements?
I recently entered into a debt settlement agreement with my creditor, but I am worried that my rights may be violated during the process. I am concerned that the creditor may not abide by the terms of the agreement, or that they may not provide me with the full protections that I am entitled to under the law. I am hoping to get some clarity on my rights as a debtor in this situation so that I can protect myself.
Diane D.
Without seeing the settlement agreement, there is no way to tell if your rights, or what you believe to be your rights, are covered. Also, if they don't abide by the contract, you can take them to court.

Can a debt settlement agreement be transferred?
I recently received an offer from a creditor to settle a debt I owe. However, due to my current financial situation, I am unable to make the payments they are asking for. I am wondering if I can transfer the debt settlement agreement to another party, who would be able to pay the debt in full.
Diane D.
Probably not. You wil need to talk to the creditor.
