The individual must have a job offer from a US employer for a tenured or tenure-track teaching or research position or a comparable position in a private company.

  • Multinational Executives or Managers

    To be eligible for this category, the individual must have been employed outside of the US for at least one of the past three years in a managerial or executive capacity by a qualifying organization. The individual must have a job offer from a US employer for a managerial or executive position in a related company.

In addition to these specific eligibility requirements, all EB1 visa applicants must also meet general eligibility criteria, such as having a job offer from a US employer, demonstrating their intent to immigrate permanently to the US, and meeting health and character requirements.

How to Apply for the EB1 Visa

  1. Determine Eligibility. The first step in the EB1 visa application process is to determine if you meet the eligibility requirements for the category under which you are applying.
  2. Obtain a Job Offer. You must have a job offer from a US employer to apply for an EB1 visa. The job offer must be for a position related to your expertise.
  3. File Form I-140. Once you have a job offer, your employer must file Form I-140, Petition for Alien Worker, with the US Citizenship and Immigration Services (USCIS). This form will establish that you meet the eligibility requirements for the EB1 visa.
  4. Provide Evidence of Eligibility. You must provide extensive documentation to support your eligibility for the EB1 visa category under which you are applying. This may include letters of recommendation, awards and honors, publications, and other evidence of your achievements and recognition in your field.
  5. Wait for USCIS Decision. USCIS will review your petition and supporting documents to determine if you meet the eligibility requirements for the EB1 visa. If approved, you will be issued a visa number, and you can move forward with the final steps of the application process.
  6. File Form DS-260. Once you have a visa number, you can file Form DS-260, Application for Immigrant Visa and Alien Registration, with the Department of State.
  7. Attend a Visa Interview. After submitting Form DS-260, you must attend an interview at a US embassy or consulate in your home country. During the interview, the consular officer will ask about your background, qualifications, and intentions for living in the US.
  8. Receive Visa. If your application is approved, you will receive your EB1 visa, which allows you to enter the US and begin working for your US employer.
