Severance agreement and non-disparagement clauses?

I recently left my job and was offered a severance agreement. In the agreement there were two clauses, a non-compete clause and a non-disparagement clause. I am concerned about the implications of these two clauses and how they will impact my future career prospects. I am looking for clarification on the language of the clauses and what I am allowed to do, and not do, once I have signed the agreement.

Can a severance agreement be digital?

I recently accepted a voluntary severance package from my employer and have been asked to sign a severance agreement. I am curious if this agreement can be signed digitally, as I am not currently in the same city as my employer. I am looking for advice on the legalities of digital agreements and any potential risks associated with signing a severance agreement digitally.

In 1999 the California Legislature enacted the Uniform Electronic Transactions Act (the “UETA”), Civ. Code, §§ 1633.1 et seq., which provides that when a law requires a record to be in writing or requires a signature, an electronic record or signature satisfies the law. The law requires that any contract entered into between two parties may not be denied legal enforceability simply because of the use of an electronic signature. This has also be upheld in the employment law setting in some case law.

Can a Release and Waiver Agreement protect me from liability if someone gets injured while participating in an activity I organized?

I recently organized a charity event where participants engage in physically demanding activities such as obstacle courses and sports. I want to ensure that I am not held liable for any injuries that may occur during the event, so I am considering having participants sign a Release and Waiver Agreement. However, I am unsure if this agreement would actually protect me from potential legal claims and if there are any specific requirements or limitations I should be aware of when drafting the agreement.

First, if a participant is under 18, their parent or legal guardian must sign for them. Second, all these types of releases/waivers do is slow people down or discourage them from suing, but a good attorney can get around most of these (especially ones you buy off the internet). You should, at a minimum, make a good effort to ensure that all activities are as safe as possible, and also make sure you, your Board members, staff, and the organization are covered by solid insurance. I'm not trying to discourage you - I just want you to be very careful.

How long is a typical rental agreement?

I am a landlord who is looking to rent out a property I own. I am in the process of drafting a rental agreement but I am unsure of the typical length of a rental agreement. I need to know how long a typical rental agreement is in order to ensure I am making a legally binding agreement.

In North Carolina, it is hard to identify a "typical" length of a property rental agreement. A one-year term is quite common for residential rental agreements. However, for commercial rental agreements, duration varies widely. For example, a lease agreement for a suite in a hair salon might be month-to-month while a lease agreement for a medical facility might be for ten years or longer. In and of itself, the length of a property rental agreement does not determine its validity; but it can certainly affect other aspects of the rental relationship. For example, duration might affect whether the rental agreement must be recorded, whether the landlord must have insurance, how much notice one party must give the other in specific circumstances, and even what happens when the lease expires. Once in effect, a faulty rental agreement can leave a landlord with fewer rights and more liability exposure than expected. It might not hurt to have a knowledgeable attorney review a proposed rental agreement before presenting it to a prospective tenant to sign.
