What's intellectual property in an employment contract?
I recently accepted a job offer that contained an employment contract. The contract states that I will not use any intellectual property of the company without prior written consent. I am unsure what exactly constitutes as intellectual property and would like to get a better understanding of the definition of intellectual property in the context of an employment contract.

Your Agreement may contain a definition like this: “Intellectual Property” means recognized protectable rights and interests such as: patents (whether or not issued), copyrights, trademarks, service marks, applications for any of the foregoing, inventions, Confidential Information, trade secrets, trade dress, domain names, logos, insignia, color combinations, slogans, moral rights, right of publicity, author’s rights, contract and licensing rights, works, mask works, industrial design rights, rights of priority, know how, design flows, methodologies, devices business processes, developments, innovations. But a few of these are going to be most likely available to you. Internal company know-how or “ how we do things here that help us succeed”. Note the words “Confidential Information”. Confidential Information is another defined term which includes customer and employee information, pricing and business strategy and plans, among others.

Are employee separation agreements required?
I recently left my job after two years of employment and my former employer has asked me to sign a separation agreement. I am unsure if I am legally obligated to sign this agreement or if employee separation agreements are required by law. I am hesitant to sign the agreement until I have a better understanding of my rights and obligations.

When an employee leaves a company, an employer can offer severance agreement/separation agreement/termination agreement, where employer offers a severance package to the employee (e.g., lump sum money, extended benefits) in exchange for limiting their liability (e.g., release of certain legal claims, confidentiality provisions). An employee can decide whether to accept the severance agreement as-is, whether to negotiate for more favorable terms or to reject the offer. You may consult an attorney to review the severance agreement to understand your rights, obligations, the benefit you are receiving, and the claims you are waiving.

Can an employee be forced to sign a separation agreement that includes non-compete clauses?
I recently received a separation agreement from my employer, which includes non-compete clauses that restrict me from working in the same industry for a certain period of time. I am concerned about the potential impact on my career prospects and wonder if I can be legally compelled to sign such an agreement.

Forced? No. Can they condition signature to receiving some form of severance? Yes. Can they condition it to receive a final paycheck of money earned? No. Can they include a non-compete in a separation agreement? Yes… but California has VERY employee-friendly laws related to non-competes. The specifics of the presented language in the agreement will matter and should be reviewed by competent counsel in your jurisdiction.

Can I file an EEOC complaint for workplace discrimination based on my disability?
I have been working at my current job for several years and recently I have been facing discrimination from my supervisor due to my disability. Despite providing all necessary documentation and accommodations, my supervisor has been consistently undermining my work, excluding me from important meetings, and making derogatory comments about my disability. I am now considering filing an EEOC complaint, but I am uncertain about the process and if I have a strong case.

Short answer: Yes. There are some siginficant deadlines (180 days and up to 300 days) you will need to meet, forms to fill out, and a venue to choose (California law vs. Federal law). Without more specific it is difficult to give you specifics, Thus, given the deadlines and the specifics of your case, I HIGHLY recommend you speak with an employment lawyer very quickly to fully understand where you in the timline, what you will need to prove, and where to file -- and more importantly, if you have a case. In California, Is a Non-Circumvention agreement signed as an employee be enforceable if the employer lays off said employee?
As an employee I was presented and signed a Non-Disclosure & Non-Circumvention agreement. I was recently told that Friday July 29, 2022 is my last day solely because the employer can no longer afford my position. They have also presented the idea of hiring me as an independent contractor. In the proposal, my current employer reminded me of the signed agreement. I would like to know if I sign the agreement for contracted work, is the Non-Circumvention agreement still valid since the Employer Employee relationship has ceased at no fault of the employee?

You will need to talk to someone in California, specifically. I am not licensed in your state. Generally, it is possible for terms of an agreement to service termination of other aspects of the agreement. This comes up in employment contracts all the time. The answer to your question most likely exists in the text of your agreement. Take that to a local attorney - aside from the text in the document, there may well be case law in California that would set an upper limit on how long such restrictions can last.
