Quick Facts — H-1B Visa Lawyers

An H-1B visa application is a non-immigrant visa process that lets U.S. employers petition for foreign workers in specialty jobs to work temporarily in the U.S. These occupations require specialized knowledge and a bachelor's degree or higher in a specific field. The H-1B visa program has been a critical component of the U.S. economy, as it allows companies to fill skill gaps and stay competitive in a global market.

How to Apply for an H1B Visa

  1. Find a Sponsor. The first step is to find a U.S. employer willing to sponsor your H1B visa application. This can be a company you already work for, or you can search for open job openings for foreign workers.
  2. Check Eligibility. Once you have a sponsor, you must ensure that you meet the H1B visa eligibility criteria. You must have a bachelor's degree or higher in a specialized field and a job offer in a specialty occupation.
  3. Labor Condition Application (LCA). Your employer must file an LCA with the U.S. Department of Labor (DOL). This application certifies that your employer will pay you the prevailing wage for your job and that hiring a foreign worker will not negatively impact U.S. workers.
  4. File Form I-129. Once the LCA is approved, your employer must file Form I-129, Petition for Non-immigrant Workers with U.S. Citizenship and Immigration Services (USCIS). This form includes information about you, your employer, and the job offer.
  5. Wait for Processing. USCIS will review your application and may request additional information or documentation. Processing times can vary, and it may take several months to receive a decision.
  6. Consular Processing. If you are outside the U.S. at the time of the decision, you must complete consular processing. This involves attending an interview at a U.S. consulate or embassy to obtain your H1B visa.
  7. Enter the U.S. Once you have your visa, you can enter the U.S. and begin working for your employer. Your H1B visa is valid for up to three years and can be extended to six years.

It's important to note that the H1B visa application process can be complex and may require the assistance of an immigration attorney. Additionally, limited numbers of H1B visas are available each year, and the application process can be highly competitive.

Tips for a Successful H1B Visa Application

  • Start Early

The H1B visa application process can take several months, so starting as early as possible is important.

  • Choose the Right Employer

It's important to choose an employer who is experienced in sponsoring H1B visas and has a good track record.

  • Provide Accurate and Complete Information

It's essential to provide accurate and complete information on all forms and documents. Any inconsistencies or errors can result in delays or even a denial.

  • Meet Eligibility Requirements

Make sure you meet all the eligibility requirements for the H1B visa, including having a bachelor's degree or higher in a specialized field and a job offer in a specialty occupation.

  • Address Any Red Flags

If you have any red flags in your application, such as a gap in employment or criminal history, address them in your application and provide any necessary documentation.

  • Use an Immigration Attorney

Consider using an experienced immigration attorney to help you with the application process. They can help ensure that all forms and documents are completed correctly and can address any legal issues that arise.

  • Be Prepared for an Interview

If you are required to attend an interview as part of the application process, be prepared to answer questions about your background, qualifications, and job offer.

  • Stay Up-to-Date on Changes

Keep up-to-date on any changes to the H1B visa program, such as changes to eligibility requirements or the number of visas available each year. This can help you plan your application and increase your chances of success.

  • Prevailing Wage: The prevailing wage is the minimum wage employers must pay H1B workers in the same geographic area and occupation as U.S. workers with similar qualifications and experience.
  • Labor Condition Application (LCA): The LCA is a form that employers must file with the U.S. Department of Labor (DOL) to certify that they will pay the prevailing wage and that hiring a foreign worker will not negatively impact U.S. workers.
  • Form I-129: Form I-129 is the petition that employers must file with U.S. Citizenship and Immigration Services (USCIS) to sponsor a foreign worker for an H1B visa.
  • Cap: The H1B visa program has an annual cap, or limit, on the number of visas available each year. Currently, the cap is set at 65,000 visas per year, with an additional 20,000 visas available for individuals with advanced degrees from U.S. universities.

Final Thoughts on the H1B Application

In conclusion, the H1B visa program allows highly skilled foreign workers to work in the United States in specialty occupations. The program has strict eligibility requirements, and the application process can be complex and highly competitive. It's important to start the process early, choose the right employer, provide accurate and complete information, address any red flags, and stay up-to-date on any changes to the program.

Working with an experienced immigration attorney can also increase your chances of success. The H1B visa program is an important way for U.S. companies to access talent worldwide and for foreign workers to advance their careers in the United States.

Unique Hybrid Background ➲ Deep Legal, Tech & Commercial Experience More by pure chance than design, I arrived late in life to pursue a career in law. My background spans more than 3 decades across Information Technology, entrepreneurship & the legal profession supporting my claim to being a 'Deep Generalist'. What is a 'Deep Generalist'? 'The professionals who develop into really great client advisors are deep generalists.' Quote from Warren Bennis. From 2013 I worked for established boutique property, finance & commercial law firms + an award-winning #newlaw firm of senior lawyers (formerly Nexus Law Group, now merged with Arch.law) before founding my digital law firm Blue Ocean Law Group in 2017. I also worked part-time for 2 years as a freelance online expert across all aspects of Australian Law with JustAnswer (H.Q. in San Francisco) and volunteered at the Caxton Legal Centre to give back to the community. Now I offer pro bono (free) legal assistance at my discretion. My achievements in the law are best reflected in the high number of settlements where civil litigation has been avoided, court judgements (incl. successful appeals) in my clients' favour & [90+] testimonials which can be seen on the blueocean.law [700+] page website which offers tons [585+] of both free & paid innovative legal products & resources. My personal experience as a client on the other side of legal matters affords me a unique perspective and goes some way to explaining my passion for the reinvention of the delivery of legal services. I am an early adopter of technology + gadgets, an avid reader and an animal lover. In January 2023, I joined the IAPP – International Association of Privacy Professionals and became a Certified Information Privacy Professional – United States by gaining the highly valued gold-standard ANSI-Accredited CIPP/US credential. I followed this up in August 2023, by obtaining the Certified in CyberSecurity qualification form ISC(2). Pre-Law Background From 1992 to 2002, I worked for Accenture as an IT Project Manager across APAC (including long-term project assignments in New Zealand & Singapore). I started a small business side hustle in 1997 and in 2003 I left Accenture to become a full-time entrepreneur in the transport industry. I later expanded into the mezzanine property development finance market as well as venturing into small-scale property development.Unique Hybrid Background
