What are Common Types of Tax Fraud?

Don’t leave filing your tax returns to your accountant. Scrutinize them for any omissions or errors before they are filed. If there is incorrect information on your tax return, you have the opportunity to file an amended return and this can occur up to three years after your original tax filing deadline.

Work With the IRS

How Should You Report Tax Fraud?

If you’re the victim of tax fraud or you know of someone who is committing it, you should report it to the IRS. Here is what to do.

  • Submit a tip. If you’re not the victim of fraud but you suspect an individual or company of fraud, you can send a confidential tip by completing Form 3949-A on the IRS website.
  • File a formal complaint. If you’re dealing with a fraudulent tax preparer, you can complete Form 14157 on the IRS website. You will have to include an affidavit.
  • Report tax ID theft. If you’re the victim of someone using your identity to file fake tax returns, you should report it to the IRS by completing their Form 14039. You will submit it with your tax return.

How is Tax Fraud Investigated?

Being investigated for tax fraud can be a frightening and stressful experience. It can arise from various reasons, such as because one of the IRS’s Revenue Agents have discovered fraud. These agents search for fraud when auditing one’s income, estate, or gift tax returns.

In companies, agents might uncover fraud during a routine audit.

When a Revenue Agent learns of the presence of fraud, they will draft a Referral report for Potential Fraud Cases, which contains information they have collected. An investigation will follow.

  • The IRS will interview witnesses and request documents.
  • The agent conducting the investigation will formalize it with an Assistant United States Attorney (AUSA), who will issue a subpoena to witnesses or request testimony to appear before a grand jury.
  • Grand jurors will consider the information presented. They will decide if they should indict the individual who has committed the tax fraud. This refers to formal charges made against you.
