Hi - is my noncompete enforceable? I live in California I work for a marketing agency (mostly doing design) and have an offer from another agency with more pay and wanted to know my options. I signed a contract with my employer when I started but not sure if I would be violating it by taking a new job. I can see a noncompete clause in the agreement. I really want to take this new job but I want to make sure I am not going to get in trouble by breaching my employment contract terms. Can you help me figure this out?

Can I take a new job with a noncompete agreement? Background - I am a pharmaceutical sales rep and I have an employment contract with my current employer that has a noncompete clause in it. I have a new offer from a similar company that sells a different type of product and I wanted to know if my current employment contract / noncompete would allow me to take this job. Is this something you can help with? Let me know what questions you may have for me. Thank you!

Hello! Thank you so much for coming to contractscounsel.com. My name is Dolan, and I am happy to help. Generally, on California, non-compete agreements are generally unenforceable. The state's Business and Professions Code at Section 16600 declares that any contract restraining someone from engaging in a lawful profession, trade, or business is void. https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?sectionNum=16600&lawCode=BPC What does this mean?

I never knew how difficult it was to obtain representation or a lawyer, and ContractsCounsel was EXACTLY the type of service I was hoping for when I was in a pinch. Working with their service was efficient, effective and made me feel in control. Thank you so much and should I ever need attorney services down the road, I'll certainly be a repeat customer.

I got 5 bids within 24h of posting my project. I choose the person who provided the most detailed and relevant intro letter, highlighting their experience relevant to my project. I am very satisfied with the outcome and quality of the two agreements that were produced, they actually far exceed my expectations.
