I provide$5000 deposit to reserve an apt for my mother in an ALF. Was gold it would be returned if she needed a higher level of care, which she did. they refused to refund

When I asked why they could not reimburse even part of the deopost becasue she needed a higher level of care, they then told me that the $5000 had already been paid to the attorney who propared the promissary note. I have researched the cost of promissory notes and they run at abbout $575 max, I then asked if tthat money could be put toward her goin to the faciity once she had become more stable and they said they would look intoit and never got back to me.

I am sorry to hear about this situation. Your rights will be primarily dictated by the terms of the contract you signed when you gave the deposit, as well as any subsequent written communications with them. Assuming the terms therein are favorable, a demand letter from an attorney setting forth what specially you want from them and why it’s permitted is the best chance you have of getting this resolved quickly in your favor.

Auto purchase agreement on trade in payoff.

The dealer we recently purchased a new car from didn’t pay off our trade in until 7 weeks after the contact. In Texas they have 25 days to pay off a trade in. We asked the dealer to to push back our payment 2 months since they were late paying off our trade in. I called the bank we financed with (Kia Financial) and they said to go to the dealer and have them push back the contract payments 2 months The dealer is saying there’s nothing they can do. I feel like we are being taken completely advantage of.

Have you spoken to the dealers manager or the manager of the dealership? if you haven't already done so, you should. Make sure to mention the delay in the dealer paying off the trade in and the fact that you called the the bank and they have told you this delay of two months can be done. If they don't listen to you, then it would be time to hire an attorney to assist you. Can a photography license agreement restrict the use of photographs taken in public places?

As a professional photographer, I often capture images in public places, such as city streets and parks, and license them to clients for various purposes. Recently, I received a photography license agreement from a potential client that includes a clause restricting the use of photographs taken in public places without obtaining additional permissions or model releases. I am unsure if such a clause is legally enforceable and if it infringes on my rights as a photographer to freely capture and license images in public spaces. Can a photography license agreement restrict the use of photographs taken in public places, and if so, what are the limitations and considerations that need to be taken into account?

You can put pretty much any kid of restriction in your agreement and decide what you want and not want transferred. It's your artistic work, it does not matter what the picture is of (I guess maybe it's difficult to prove the photo is yours?). However, in a breach of contract situation, you need to show your damages. I would consider some liquidated damages provision that they would pay you a set amount if it used for any other purpose.
