Real Estate Lease Agreement
Colorado
Can I break a commercial lease if landlord stops providing heat?
I have been renting a commercial space for more than ten years. There have been consistent issues with heating and AC, as well as a leaking roof. For two weeks now there has been a major issue with the heater—it is not working. I have filed two maintenance requests, the first of which said the issue was handled. I just found out today (14 March) after reaching out a lot that the heater needs parts that are back ordered and won’t be available until 7 April. This is the last straw for me. I am wondering what the chances are of getting a letter about breaking the lease and being given time to find a new space. Any advice is helpful, and if this is possible I would love to get a quote.

It depends on the terms of the lease. The apartment is not habitable at the moment, so you should at least get a rent abatement. You should have a Colorado attorney review the lease.

Land Lease Agreement
Georgia
Can a landlord terminate a land lease agreement before the agreed-upon term expires?
I recently entered into a land lease agreement to rent a plot of land for my business, with a term of 5 years. However, the landlord has informed me that they want to terminate the lease agreement before the agreed-upon term expires. I am concerned about my rights as a tenant and whether the landlord has the legal authority to terminate the lease prematurely.
Jerome L.
Hi there, Generally, a landlord cannot unilaterally terminate a land lease agreement before the end of the agreed-upon term—especially if the lease is for a fixed period like 5 years—unless the lease specifically allows for early termination or you, as the tenant, have violated the lease terms. Here is what you need to know: Understanding Your Rights as a Tenant: Fixed-Term Leases Are Binding Contracts: A 5-year lease creates a legally enforceable agreement. Unless the lease contains an early termination clause, the landlord is bound to honor the full term. Landlord Cannot Terminate Without Cause: If you are in full compliance—paying rent on time and following the lease terms—the landlord typically has no legal authority to terminate the lease early without breaching the agreement. Review the Lease Terms: Carefully review your lease for: Termination clauses Conditions for default or breach Notice requirements These will determine what rights the landlord may—or may not—have. You May Be Entitled to Remedies: If the landlord attempts to terminate without proper grounds, you may be able to: Enforce the lease and stay on the property Seek damages for any losses you incur due to early termination File a legal action for breach of contract, if necessary Early Termination Negotiations (Optional): In some cases, parties can agree to a mutual termination with compensation, but this is entirely voluntary and should benefit both sides. I recommend consulting a real estate attorney to review your lease and protect your rights. If you are operating a business on the property, there could be additional legal protections available to you depending on the nature of the lease and local laws. Feel free to reach out if you would like help reviewing your lease or exploring your options. Best regards, Jerome Lucas Newell, Esq. Real Estate & Business Law Attorney

Property Sale Agreement
Ohio
What are the legal implications of including an 'as-is' clause in a Property Sale Agreement?
I am in the process of selling a property, and I am considering including an 'as-is' clause in the Sale Agreement to protect myself from any potential liability for defects or issues with the property that may arise after the sale is complete. However, I am unsure of the legal implications of such a clause and whether it would truly absolve me of any responsibility. I would like to understand the potential risks and benefits of including this clause from a legal perspective before finalizing the agreement.
Gary S.
Hello and thank you for the opportunity to respond to this very important question. First, an "as is" clause in a Property Sale Agreement shifts the risk to the buyer. The burden of due diligence is shifted to the buyer and the property is being sold in its current condition, with no warranties or representations about the property's condition. In this way, the seller's liability is limited, as the seller is generally not liable for defects, even hidden ones, that the buyer could have discovered through a reasonable inspection. However, the seller's limited liability does not apply if the seller actively conceals a defect. Also, in Ohio, when selling "as is", the seller still has a duty to disclose, and not fraudulently misrepresent, known material defects. Failing to do so can lead to breach of contract, fraud claims, rescission of sale, and potential damages. Ultimately, when property is sold "as is", the buyer is expected to conduct inspections and investigations and negotiate repair terms or price reductions. Further, selling "as is" may affect the ability to finance the sale and/or insure the property, depending on the condition of the property. It is also important to note that courts tend to scrutinize the exact wording of the "as is" clause, and a broad, well-drafted clause will offer stronger protection to the seller. You should consult a qualified attorney licensed in your jurisdiction for advice specific to your situation.

Lease To Purchase Option Agreement
Tennessee
If you're doing a rent to own on a house and the owner dies, can the executor or heirs kick you out of the house, raise the monthly price, or raise the amount of the house or do they have to honor the contract in it's entirety? In Tennessee
I have been renting to own for a few years now. We pay so much a month and have put additional money in the house fixing the house up. We have a certain price that we are paying for the house. The owner died yesterday, and the sister/executor of the will called me this morning saying he died and they were coming to look at the house. Said they were probably going to raise the monthly payment and probably going to raise the price of the house. I'm scared they are either going to kick me out or not let me do rent to own or raise the price. She also said I owed rent for this month which I have already paid!
Rebecca R.
If your rent-to-own contract is in writing then the contract should be binding on the owner's estate, although there may be some practical challenges in enforcing it. If your contract is not in writing you will have several practical proof problems to overcome, and you may have trouble overcoming the executor's challenges to the contract. As a tenant in possession you may have additional rights to recover investments in the house, or maintain your current amount of rent. As with the purchase option, your rights may depend on the language of your written agreement.

Property Deed
Wyoming
Does a quitclaim deed give you ownership?
I want to learn how these work. Can anyone explain?
Michael S.
Caveat- I'm a Pennsylvania lawyer. That being said, a quitclaim deed gives you the exact same rights as the party conveying title to you. So if there are liens against the property, for instance, those liens would remain after you take title. Preferably, you would have a title search performed and receive a warranty deed, which would protect you against claims against the property.
Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
