Can I break a commercial lease if landlord stops providing heat?

I have been renting a commercial space for more than ten years. There have been consistent issues with heating and AC, as well as a leaking roof. For two weeks now there has been a major issue with the heater—it is not working. I have filed two maintenance requests, the first of which said the issue was handled. I just found out today (14 March) after reaching out a lot that the heater needs parts that are back ordered and won’t be available until 7 April. This is the last straw for me. I am wondering what the chances are of getting a letter about breaking the lease and being given time to find a new space. Any advice is helpful, and if this is possible I would love to get a quote.

It depends on the terms of the lease. The apartment is not habitable at the moment, so you should at least get a rent abatement. You should have a Colorado attorney review the lease.

I am in the process of purchasing a property and the lender has requested that I sign a Subordination Agreement, but I am unsure of what this entails and how it may affect my rights as a borrower. I want to understand the purpose and implications of a Subordination Agreement before signing it, as well as any potential risks or benefits involved in agreeing to it.

The exact situation is unclear as Subordination is usually when you are selling rather than buying. Subordination means putting something in a lower priority compared to something else. In legal and financial terms, it usually comes up when talking about loans or claims. When one party agrees to “subordinate” their claim, they’re saying: “I’ll wait in line — you get paid before I do.” There must be multiple loans or claims and bank is establishing the order they'll get paid.

Can a landlord terminate a land lease agreement before the agreed-upon term expires?

I recently entered into a land lease agreement to rent a plot of land for my business, with a term of 5 years. However, the landlord has informed me that they want to terminate the lease agreement before the agreed-upon term expires. I am concerned about my rights as a tenant and whether the landlord has the legal authority to terminate the lease prematurely.

Hi there, Generally, a landlord cannot unilaterally terminate a land lease agreement before the end of the agreed-upon term—especially if the lease is for a fixed period like 5 years—unless the lease specifically allows for early termination or you, as the tenant, have violated the lease terms. Here is what you need to know: Understanding Your Rights as a Tenant: Fixed-Term Leases Are Binding Contracts: A 5-year lease creates a legally enforceable agreement. Unless the lease contains an early termination clause, the landlord is bound to honor the full term. Landlord Cannot Terminate Without Cause: If you are in full compliance—paying rent on time and following the lease terms—the landlord typically has no legal authority to terminate the lease early without breaching the agreement. Review the Lease Terms: Carefully review your lease for: Termination clauses Conditions for default or breach Notice requirements These will determine what rights the landlord may—or may not—have. You May Be Entitled to Remedies: If the landlord attempts to terminate without proper grounds, you may be able to: Enforce the lease and stay on the property Seek damages for any losses you incur due to early termination File a legal action for breach of contract, if necessary Early Termination Negotiations (Optional): In some cases, parties can agree to a mutual termination with compensation, but this is entirely voluntary and should benefit both sides. A triple net lease designates the tenant (lessee) as having the sole responsibility for any and all costs associated to the asset being leased in the agreement, with those costs being the net real estate taxes on the leased asset, net building insurance, and net common area maintenance. The lease received its name from the three “net” fees and may also be called a Net-Net-Net Lease.

I recently installed solar panels on my house through a leasing agreement with a solar company. However, I am considering selling my house in the near future and I'm unsure if the lease agreement for the solar panels can be transferred to the new homeowner, or if I would need to terminate the lease before selling. I want to understand my rights and obligations regarding the solar panel lease agreement in the event of selling my home.
