I have a Bachelors in Biology, Chemistry and French, JD from Seattle University and Masters in Environmental Science and Law from Vermont Law School. I have traveled extensively, mostly in Europe, and speak several languages with more or less proficiency. I practiced law in Alaska and Colorado, much of it in remote areas but also large cities. What type of attorney would I hire for a problem with a HVAC contractor that installed the wrong size of equipment.
I hired a HVAC company to install a new heating and cooling system to replace existing units. The problem is they installed undersized units
Dean F.
A civil litigation attorney can help you resolve a dispute with an HVAC contractor. They typically will help you try to resolve the issue prior to filing suit. And if that does not resolve it, they are experienced in litigating matters in court.

Settlement Agreement

How to I get paid from this settlement without having to spend thousands on an attorney
Hello. Through legal help, I have a signed agreement with the other side to pay me $6500 in the settlement, after the other side did not deliver the product i signed on or. Before the attorneys got involved, I wrote a bad review about the 'others sides' business and posted it on the USREVIEW website. In the settlement agreement, i agreed to delete that post (review) however, i cannot. The 'other side' has the ability to have the review deleted, but he refuses to do so, using a stalling tactic not to pay me the settlement. The other side is in the UK. I have already wasted a lot of money on a lawyer from the U.S, he did not help much. I am now working with a lawyer in the UK, however, she is not sure that i will collect, even if we go to trial and win. Do i give up on this settlement, or is there another way to collect on the settlement without having to waste thousands of dollars?
Donya G.
Hello, It depends. Is your settlement court approved? Did you go to court and the court approved it or was it drafted by attorneys only? If it is not court approved, you can seek to have it approved by the court, however, you would need to be able to serve the person who is in the UK. Do they have a US address? will their lawyer accept service? Do they have property in the US? If yes, then you can sue in small claims court in NJ but only for $3,000.00, which is the limit but it is a process you can do by yourself with guidance. Otherwise if you want to sue for the full $6,500.00 your case should be filed in the regular Special Civil Part. Does the party have assets here in the US? you might want to hire an investigator (cheaper than an attorney) to locate any assets. If they do, then with your approved court settlement, you can attach the property or file a lien to get your money back. If you need further assistance, you can contact me on the website for assistance with my services. All the best Donya Gordon

Can I create a contract that bars any form of dispute resolution (Jury trial and Mediation/Arbitration) if a client fails to dispute an invoice within 7 days of receipt.
I own a growing security guard firm and all my clients sign a service contract before we provide services. In order to reduce the stress of collecting from a slow playing client, I want to create a new contract that makes it impossible to dispute an invoice after 7 days of receipt.
Donya G.
While you may create a contract without dispute resolution, the issue is whether it would be enforceable by any court. Seeing that a contract is between two parties and disputes arise, by barring any resolution, it would essentially not afford a party an opportunity to be heard. I do not believe a court would allow of enforce such a position. If you need additional assistance you can find me on the Contracts Counsel website and I can provide my legal services to you. Thanks Donya Gordon

Should I sign a contract if I don't understand what it is saying?
Has a contract with someone where if we disagreed we would go to mediation. They refused to go, they offered us a settlement as long as we signed another contract. I don't understand fully what it is saying.
Donya G.
Absolutely NOT. You never sign ANYTHING you do not understand because when you sign, you become bound to those terms whether you understood them or not or whether you agree with them or not. Should you later have a disagreement on the contract you signed, the court, or arbitrator will see your signature on the document as a sign that you read, understood and agreed to the terms. You will need to hire an attorney to review the initial agreement to see if they can refuse mediation as well as to look at the new contract and let you know what it says and whether you should sign it or not. I am a contracts attorney and if you you would like my services, you can contact me on the contracts counsel website.
