Can a landlord increase the rent during the term of a lease agreement?

I recently signed a one-year lease agreement for an apartment, and it explicitly states the monthly rent amount. However, my landlord has informed me that they will be increasing the rent halfway through the lease term. I want to know if this is legally permissible, as I understood that the rent amount was fixed for the duration of the lease agreement.

Hi, Without reviewing the entire lease it is difficult to give a thorough answer, but it is likely legally permissible. In Maryland, the rules for rent increases vary based on the type of lease. For leases longer than a month, landlords must give a notice of 90 days. If a lease is between a week and a month, a 60-day notice is needed. Oral leases of a week or less require just 21 days' notice. For leases with a written contract of one week or less, only a 7-day notice is required. These rules ensure tenants have enough time to plan for changes in their rent, and can move if necessary. Refer to the Renters' Rights Stabilization Act of 2024 with a licensed lawyer for more information.

What's the parking situation in a commercial lease?

I am currently in the process of signing a commercial lease for a retail store and I need to know the parking situation that is included in the lease. I have read through the lease and I'm not sure if the parking is included or if I have to arrange it myself. I need to know if I will be able to provide adequate parking for my customers and employees.

Can a release of lien be obtained if the original lienholder cannot be located?

I recently purchased a property and discovered that there is a lien against it from a previous owner's unpaid contractor. However, I have been unable to locate the original lienholder to request a release of lien. I need to know if it is possible to obtain a release of lien in this situation, and if so, what steps I should take to ensure the lien is cleared from the property's title.

You have several alternatives. Did your original title policy insure against liens? If so, I can work with the title company to have the lien removed. Second, if the lien is old, it may have already expired and can be removed as a matter of law. Third, there are procedures in every state to remove a lien if the lienholder cannot be located. Finally, we may be able to have the title insurance company insure over the lien. Tom

When to use a quitclaim deed?

I recently inherited a piece of property from a family member and I am looking to transfer ownership to another family member. I am not sure if a Quitclaim deed is the correct way to do this, and I am seeking legal advice to understand when to use a Quitclaim deed in this situation.

Notwithstanding any statory formalities required for purposes of recording in the public records, in theory, any writing in which an owner intends to transfer propery that is adquatedly described and delivered to the transferee may function as a deed. However, in practice, you will find there are generally three broad categories of deeds mostly used to convey property in Georgia, depending on certain warranties, or the lack thereof, contained therein. These categorizes include warranty deeds, limited warranty deeds, and quitclaim deeds. In a warranty or general warranty deed, the grantor generally warrants title, and promises to defend the grantee against third party title claims that either arose, or which are based on events occuring at anytime during the grantor's ownership of property OR the ownership of any of the grantor's predecessors in title. In a limited warranty deed, a grantor generally only warrants and promises to defend the grantee against title claims which arose, or which are based on events occuring during the grantor's ownership. A quitclaim deed generally contains no warranties. Therefore, the grantee or transferee of a quitclaim deed has little to no recourse against the grantor if there is an issue with the title to the property based on the deed alone. Generally, in circumstances where there is a transfer of family property, between family members, in which no money is being exchanged, a quitclaim deed is fine. However, there may be certain tax consequences if the family member were to later resale the property. He/she may want to consult a tax professional prior to do so.

Can a release of lien be obtained without paying off the underlying debt?

I purchased a property that had an existing lien on it, and the seller promised to obtain a release of lien before the closing, but now they are refusing to do so unless I pay off the remaining debt, even though the lien was filed against them, not me - I want to know if it is possible to obtain a release of lien without having to pay off the underlying debt.

The standard practice is that any lien against the property should be paid off at or before closing. You should also have obtained title insurance, which generally covers liens that were not satisfied. You should have received a copy of your title insurance policy sometime after closing, and the lien coverage (or any exception) should appear on the policy. At this point, you should contact an attorney to review all of your closing documents and advise you on the best course of action.
