Generally, if a person is competent, he or she can revoke a power of attorney at any time and execute a new one in favor of someone else. Every individual/business that is aware of the previous power of attorney will need to be notified that it has been revoked and given the updated power of attorney. However, if a person has any conditions that may be impairing mental functions, it may be necessary to petition the court for guardianship/conservatorship. Both of these scenarios can get complicated incredibly fast, and you should consult with a lawyer in either situation.

Do I need a lawyer to get a power of attorney
My uncle is an elderly man and his wife passed away in January of this year. She did everything as far handling all of the important things. He doesn't understand a lot of things. He asked me if I would take over everything for him. So I think I need to get a power of attorney to be able to do tnat.

A power of attorney allows you to make decisions and dispose of property, it does sound like one might be helpful in your situation. When an attorney writes up the power of attorney, you have a range of permissions to cover all the needs of your individual situation. You’ll want to be sure that you have the ability to write checks, etc. Additionally, the power of attorney will be useful if other family members challenge your decisions or actions. Drafting the document is a fairly straightforward process, and most attorneys will bill 1-2 hours depending on whether you need additional documents for healthcare and estate decisions.

Must I sign a family settlement release for my fathers estate in PA in order for the executor to distribute monies?
My fathers exectutor is ready to finalize the estate bank account and I received a "release" letter, must I sign it before money is distributed? (PA)

In Pennsylvania, probate estates are wrapped up after the executor provides the beneficiaries with an accounting. The purpose is for the beneficiaries to review what the executor did during the administration of the estate and have the opportunity to voice any objections he or she may have. The release that you received is fairly standard in the estate administration process. You are not required to sign the document. The estate can also be finalized by requesting an order of distribution from a judge. If you do not happen to take issue with anything the executor did, signing the release agreement will likely be more efficient.

I'm not a fan of either term as I find they just confuse things. Durable usually is referring that it remains effective after incapacity. Sometimes general is looked at as terminating at becoming incapacitated. Another term which comes up is springing which this one makes more sense where it isn't effective immediately but upon a date or occurrence (usually someone being deemed incapacitated). I don't think I'd ever create a POA where it terminates at incapacity since that's when I'd need it to work. Now you say your mother has dementia. Will she understand what she is signing and the purpose of the document? If not, she doesn't have the required mental capacity to establish a POA and will have to have a guardian appointed by the court.

How do I exclude a child from my will?
I want to write my will and exclude an estranged son. Can I just have a paragraph stating my son's name and that he is to receive nothing whatsoever from my estate? Should I leave him $1.00? Is there a preferred approach to make sure he can't contest my will and receive anything? We've been estranged for years. Thanks.
