Can a repayment agreement be enforced if it was made verbally and not in writing?

I recently loaned a significant amount of money to a friend in need, and we agreed on a repayment plan where they would pay me back in monthly installments. However, we did not put this agreement in writing, and it was purely a verbal agreement. Now, my friend is refusing to make the payments, and I'm wondering if I have any legal recourse to enforce the repayment agreement even though it was not formalized in writing.

I'm so sorry about your situation! My name is Dolan. The answer is yes. Under California law, a breach of contract occurs when one party fails to fulfill a legal duty the contract created and causes damages for the plaintiff. (California Civil Jury Instructions Number 303.) The measure of damages is the amount that will compensate the aggrieved party for all the detriment caused thereby or likely to result therefrom. (Cal. Civ. Code § 3300.) Parties can also seek '"specific performance" of the agreement under section 3388 of the civil code. This applies regardless of whether the agreement was written or done orally. Typically, the aggrieved party is entitled to be returned to the same position they were in before the breach. Before entering into a lease agreement for solar panels, it’s essential to weigh both business and legal considerations to avoid long-term risks and ensure the agreement aligns with your financial goals and property plans. LEGAL CONSIDERATIONS 1. Ownership Who owns the panels? Under a lease, the installer (lessor) typically retains ownership. This typically means you can’t claim tax credits or depreciation (the lessor can). 2. Property Access Rights Does the agreement allow the company to access your roof or property for installation, maintenance, and inspection? Are there limits on timing, frequency, and notice? 3. Term and Termination How long is the lease? (Often 15–25 years) Can you terminate early, and if so, under what conditions? Are there early termination penalties? 4. Transferability What happens if you sell your home? Can the lease be transferred to the buyer? Must the lease be bought out first? Will the lease create issues with real estate financing or title? 5. Liability and Insurance Who is responsible if the panels damage your roof or cause injury or fire? Does the installer carry liability insurance? Does your homeowner’s insurance need to change? 6. How broad/reasonable the clause is, is there a liquidated damages clause, are they asking for equitable relief, etc. And of course, all these likely involve litigation. Depends on what the content creator agreement with the platform says about termination. It likely has the platform covered. If they didn't follow the terms of the agreement, you might have a claim. The claim may be limited in damages as most of these contracts, if well written, have limitations on damages under the contract.

I want to know if it is possible to end the agreement early and if there are any legal implications or penalties associated with doing so.

It is usually possible to get out of a contract for employment (or work as an independent contractor) for these types of reasons (slavery was banned in the US some 150 years ago - no one can force you to work). I suggest that you talk with the broker and ask to get out of your contract. Let him or her know that you can provide a general letter from a health care provider to back up your request based on a health reason making you unable to work and/or fulfill your contract (the letter need not give specifics or otherwise violate your privacy). This could be a bit "trickier" if the broker has invested in you, eg, paid for training, licenses, etc - if that's the case, be prepared for this, and have a counter-offer ready, at least in your head. You will need to use all your negotiation skills - if your health issues may limit your ability to be at your best in such negotiations, you may want to bring in someone to negotiate on your behalf - this does not need to be an attorney.
