Settlement Agreement

How to I get paid from this settlement without having to spend thousands on an attorney
Hello. Through legal help, I have a signed agreement with the other side to pay me $6500 in the settlement, after the other side did not deliver the product i signed on or. Before the attorneys got involved, I wrote a bad review about the 'others sides' business and posted it on the USREVIEW website. In the settlement agreement, i agreed to delete that post (review) however, i cannot. The 'other side' has the ability to have the review deleted, but he refuses to do so, using a stalling tactic not to pay me the settlement. The other side is in the UK. I have already wasted a lot of money on a lawyer from the U.S, he did not help much. I am now working with a lawyer in the UK, however, she is not sure that i will collect, even if we go to trial and win. Do i give up on this settlement, or is there another way to collect on the settlement without having to waste thousands of dollars?
Donya G.
Hello, It depends. Is your settlement court approved? Did you go to court and the court approved it or was it drafted by attorneys only? If it is not court approved, you can seek to have it approved by the court, however, you would need to be able to serve the person who is in the UK. Do they have a US address? will their lawyer accept service? Do they have property in the US? If yes, then you can sue in small claims court in NJ but only for $3,000.00, which is the limit but it is a process you can do by yourself with guidance. Otherwise if you want to sue for the full $6,500.00 your case should be filed in the regular Special Civil Part. Does the party have assets here in the US? you might want to hire an investigator (cheaper than an attorney) to locate any assets. If they do, then with your approved court settlement, you can attach the property or file a lien to get your money back. If you need further assistance, you can contact me on the website for assistance with my services. All the best Donya Gordon

Employment Agreement
Missouri
Is my non-compete enforceable?
If a small company made you a verbal offer of salary, car, health insurance assistance then after you signed the employment agreement, including non compete, made excuses and never made good on the car and the insurance assistance, is the non compete enforceable. I singed based on promises of a partnership and those additional perks since they didn't provide any other benefits. I turned down other opportunities because of the partnership potential and brought my own equipment and opportunity. Now after providing new business opportunity I asked for some protection in writing regarding partnership in the new technology, mainly developed by me and partly carried over from previous experience. Instead of getting the promised protection in writing I got fired. I know that it isn't in writing because of excuses but I also know they would never lie under oath. They are many things but they wouldn't do that for very religeous reasons. The non compete is onerous and those perks were to sweeten the deal so I would sign. I even met with their attorney to complain about it before signing based on their promises which then never materialized and were not provided in writing.
Donya G.
I suggest you seek an employment attorney in your area to discuss. If they are so religious, what happened to you should not have. An agreement for the partnership need to be in writing to be enforceable. If you signed an employment agreement, then you should have signed something when you were leaving. An attorney would need to review both documents to advise you going forward. All the best

I am being harassed by a vendor for the balance due for product that i have not received yet. Can i take them to court?
After receiving the incorrect product, the vendor presented me with a fake contract with my signature copy pasted on it to tell me I i agreed on the replacement product for my order. They claim they had a second meeting with me and this new contract was signed but that never happened.
Donya G.
I would suggest hiring an attorney in your jurisdiction to send a cease and desist letter to the vendor or have them simply call the vendor nd tell them to stop harassing you. For a cease and desist to have the effect that matters, it should be from a licensed attorney in that state who can file any case in court if the matter is not addressed or continues to happen. I am an attorney licensed in New York and Connecticut. There are numerous attorneys on this website from other states. If you would like me to assist, please contact me through the site or post your jobs for another attorney. All the best Donya Gordon

Can I send a cease and desist letter to someone who is spreading false information about me online?
I am a small business owner and recently discovered that a former employee has been spreading false and damaging information about me and my business on social media. This false information is negatively impacting my reputation and causing potential clients to question the credibility of my business. I want to put a stop to this and protect my reputation, so I am considering sending a cease and desist letter to the individual. I would like to know if it is legally appropriate and effective to send such a letter in this situation.
Merry K.
What I suggest you do is write a polite, professional, and firm letter to the person(s) and send the letter in a manner in which you will get a receipt, such as certified, return receipt through the post office (this costs $8.75). Keep copies of everything. Let the person know they must stop immediately and remove any and all defamatory posts.. Do not make any threats. You can have an attorney do this for you, but it will probably cost you around $1000. After you send this letter, if the problem doesn't stop, the next step would be to get a civil anti-harassment order through court. This is something you can do yourself. If this doesn't work, you can return to court with a request (motion) to the judge to hold the defendant (respondent) in contempt and ask the court to impose fines. Another option, of course, is to sue for defamation (even for a business), but this type of case would cost you thousands and thousands of dollars, and there's no guaranty than you would win and get paid by the defendant. Although this is a "women's law" website, the website has a great explanation of various types of restraining orders in Washington State. Please look at the explanation for civil harassment: https://www.womenslaw.org/laws/wa/restraining-orders/civil-anti-harassment-orders You can, of course, skip writing a letter and go straight to filling for harassment, but judges tend to like to see some reasonable effort on the part of litigants to resolve their problems on their own prior to going to court. I normally would offer to help you, but I'm going to be traveling and am not available until some time after October 17th or so. I also do not engage in litigation any more myself. Oh, I want you to know that most Washington counties have a website for their courts that provide lots of information and forms for obtaining various types of restraining orders. Best wishes, Merry Kogut
