Brianna N.
Brianna is a well-respected New York licensed attorney with a Juris Doctorate degree in law from Touro College Jacob D. Fuchsberg Law School and bachelor’s degree in Business Administration and Management from Dowling College. Since becoming an attorney, she has practiced in various areas including business law, corporate law, residential real estate, commercial real estate, criminal law, traffic law, employment law, landlord tenant law, estate planning, and has represented intermediaries in procurement and the personal protective equipment industry. Brianna has broad and extensive business experience; She is an entrepreneur and co-owner of a microtechnology manufacturing company that was built by her and her partner, where she also served as the Chief Legal Officer and Human Resource Manager for the company. While building the manufacturing business, she created a brokerage firm for business transactions and has managed several other businesses which she has ownership interest in. Brianna’s involvement in these various businesses over the past 15 years provides a unique skillset to her clients; Not only does she understand contractual principals and obligations from a legal perspective while drafting and negotiating agreements, but she also has the foresight, experience, and ability to ensure the agreement reflects the practical aspects of the business. Based on the client’s needs and desired outcome, she has the forethought to cover different angles that would be overlooked from a legal standpoint, and as a result she is able to help prevent unforeseen business ramifications. She conducts extensive risk assessments on behalf of her clients and minimizes exposure to potential liability without “over lawyering” agreements. One of Brianna’s main areas of focus is drafting and negotiating agreements. Negotiation is a passion of hers which was applied in law school while she was a member of the Alternative Dispute Resolution Society, notably winning Touro Law School’s intraschool negotiation competition. In her more recent years, Brianna has removed herself from her various business interests to focus on her law practice. Brianna has a strong moral compass and believes in quality over quantity. She treats every client as a top priority; thus, she will not take on many cases at a time because she wants to give each client the focus and attention they deserve. She has sharp attention to detail and is a forceful advocate for every client. Note Payable
New York
I need to sue on an unpaid promissory note
The note was written back in March 2019 I hired an attorney and he has done nothing for me! I made tons of requests to try to settle out of court with this man and he just keeps blowing me off
Matthew S.
You need someone who will attempt to settle the matter for you and if that fails be prepared to sue on the note and take the necessary action to collect. This assumes the debtor has assets to collect against. It can take a while. I have had some folks pay relatively promptly, others several years. Communication between attorney and client is very important in this process. If you have no idea what is going on in your case you can get very anxious. I make sure you get consulted on each development and you get copies of each filing.

Lien
California
My brother paid off the mortgage loan of my parent's home in California in Jan 2021. In return the ownership was transferred to his name. However, in mid 2023 a lien was put on the property for $80K. We had no idea who filed, after talking with my father he told us that could be a judgement for him to pay back for the "zeek reward" scheme that he joined from more than 10 years ago. Is that legal for the lien to be on the property now that my father is not the owner?
The house is an investment property with renters, my father lives in one room and we do have a rental agreement with him. He manages the property since my brother and sister who are the owners of the property are living in different states.
Joseph M.
If the judgment was against your father and not you then you should be able to fight the lien.

Debt Settlement Agreement

Creditor rights in debt settlement agreements?
I recently entered into a debt settlement agreement with my creditor, but I am worried that my rights may be violated during the process. I am concerned that the creditor may not abide by the terms of the agreement, or that they may not provide me with the full protections that I am entitled to under the law. I am hoping to get some clarity on my rights as a debtor in this situation so that I can protect myself.
Diane D.
Without seeing the settlement agreement, there is no way to tell if your rights, or what you believe to be your rights, are covered. Also, if they don't abide by the contract, you can take them to court.

Demand Letter

Demand letter and statute of limitations?
I recently received a demand letter from a creditor regarding an unpaid debt. The letter states that I must pay the full amount within 30 days or they will take legal action. I am concerned that the debt may be outside the statute of limitations, and I wanted to know what legal recourse I have in this situation.
Myrna L.
If you are certain that the debt is time barred, debtor may not sue you. In California, there is generally a 4-year limit for filing a lawsuit based on a written agreement. Just make sure you don’t inadvertently restart the statute of limitations, i.e. acknowledge the debt.

Citing laws in a demand letter?
I recently sent a demand letter to a person who I believe owes me money. I am trying to collect the payment they owe me, but they are refusing to pay. I included a few laws in the demand letter that I believe are relevant to my situation, but I am not sure if I have included all of the necessary laws. I would like to make sure I am citing all of the applicable laws in my demand letter so that I can ensure the payment is collected.
Merry A.
Unfortunately, often, one can cite all the laws one wants, but the person who owes the debt may simply be unwilling or unable to pay. If the debt is for less than $10,000, consider filing in Small Claims Court in your county. Here is the statewide information: https://www.courts.wa.gov/newsinfo/resources/?altMenu=smal&fa=newsinfo_jury.scc In addition, many counties, such as King, have their own websites and lots of information. When you file in Small Claims Court, be sure to include copies of all relevent paperwork, including any letters you sent to the defendent. And request reimbursement for the debt, interest, the cost of filing the Small Claims case, and any related costs/expenses. Even if you win, however, you may not get paid - but if you win, you will have some other ways to collect, such as garnishing wages or a bank account. I'd be happy to help coach you through the Small Claims process if you'd like to request my help through ContractsCounsel.com
