For this project, the client received 3 proposals from lawyers to review a Ground Lease in Connecticut, with flat fee bids ranging from $300 to $1,200 on a flat fee. Pricing may vary based on the complexity of the legal terms, the type of service requested, and the required turnaround time.

Project Description

In 2022, a business in Connecticut sought assistance with a ground lease document as they faced a significant challenge regarding the responsibilities for roofing expenses on an aging building. The client was dealing with a dispute between the building owner and the tenant over who should bear the cost of a necessary roof replacement, particularly since there was no formal lease contract addressing this issue. The situation was complicated by the fact that the building was 60 years old, and repairs were no longer a viable option. As a result, the client received three proposals from licensed lawyers, with flat fee bids ranging from $300 to $1,200, all submitted to meet the requested deadline of one week.

Ground Lease

Asked on Jan 29, 2025

Can a ground lease be terminated early by the lessor if the lessee violates a non-monetary covenant?

I am currently in a ground lease agreement where I am the lessee, and I recently received a notice from the lessor stating that they intend to terminate the lease due to a violation of a non-monetary covenant. The specific covenant in question pertains to the maintenance and upkeep of the property. I have been diligently maintaining the property, but there may have been some minor lapses in the past. I would like to know if the lessor has the legal right to terminate the ground lease early based on a non-monetary covenant violation, and what options I have to defend against this termination.

Hello: The success of a claim of breach of the agreement depends on whether the alleged violation of the specific non-monetary covenant is material and whether there is a right to cure it. If it is a minor or curable breach, and the lessee can cure it, then the lessee may have defenses to an alleged breach claim.
