First, since your LLC is currently treated as a disregarded entity for tax purposes, you'll need to file Form 8832 to elect corporate tax treatment. Once the IRS has processed this election, you can then file Form 2553 to specifically request S corporation status. Timing is crucial for this election. For the S corporation status to take effect in the current tax year, you must file Form 2553 either within the first two months and 15 days of that tax year, or at any time during the preceding tax year. Before proceeding, you should verify that your LLC meets all S corporation eligibility criteria.
