Project Description

In 2026, a personal client in Florida sought assistance with an affidavit related to declining an inheritance after a relative's passing. The client was concerned about the legal implications of being the closest living relative and wanted to understand their rights and options regarding filing a disclaimer of inheritance. They requested either drafting the disclaimer or reviewing a version they had prepared, looking for clarity on associated fees. As a result, the client received four proposals from licensed attorneys, with flat fee bids ranging from $225 to $2,000, all submitted in time to meet the client's deadline of over a week.

What are inheritance rights for niece and nephew?

My Aunt passed away July 9, 2021 and she had a will. On the will she stated that she wants everything left to my mother whom is deceased as well and executer of estate is my sister.

Does the will have a provision that states who will receive your aunt's assets if your mother predeceased her? If not, I believe the rules of inheritance found in the New York Statute will govern. https://www.nysenate.gov/legislation/laws/EPT/4-1.1. Your sister needs to go to the Probate Court and/or consult an estate attorney.
