"I hired Faryal for a fixed-fee review of the Terms of Service, Privacy Policy and in-app wording for a healthcare staffing app. She delivered the redline two days before the deadline, answered all 148 rows with replacement wording, replied to my follow-up questions within a day, and kept to the fixed fee she quoted. When I asked, she disclosed that she used AI as a drafting and research aid and said she verified the results against legal sources. My concern is how much of the work felt AI-generated. Many comments read as general and hedged ("subject to confirming"), with little of the specific legal judgment I was paying an attorney for. She did not give approved version numbers, a range for the liability cap, or a clear view on Virginia licensing, and checking the final assembled documents was outside the scope and would have meant a separate fee. Some of the points she flagged were useful, such as HIPAA scope, state staffing-agency rules and what not to promise about data deletion. I would suggest that anyone hiring her ask upfront how AI is used and how much of the analysis is the attorney's own."

Thank you for taking the time to share your feedback. I appreciate your acknowledgment of the timely delivery and the issues the review identified. I understand that you wanted more definitive answers on certain points. Where conclusions depended on product facts or jurisdiction specific requirements, I identified those limitations rather than present an uncertain answer as final advice. I disclosed my use of AI as a drafting and research aid when you asked; the analysis and professional judgment were my own. On Virginia licensing, my position was that Virginia’s former general employment agency licensing chapter had been repealed, but that the platform’s actual activities and any other applicable requirements still needed review by Virginia Licensed counsel. The subscription model and free access alone did not settle that question. After receiving the review and my follow up responses, you requested a quote for additional work, including a review of the assembled documents and a state by state table. I understood that request as an interest in continuing the engagement. The additional review was outside the original scope, so I proposed a separate fee which may have been higher than what you were expecting. I appreciate the feedback and will continue to make the scope, deliverables and approach clear at the outset if you wish to engage me further.

Can a company change its Terms of Service and Privacy Policy without notifying its users?
I recently discovered that a popular online platform I use has made significant changes to its Terms of Service and Privacy Policy, which I was not notified about. These changes seem to give the company more access to my personal data and reduce my rights as a user. I'm concerned about the implications of these changes and whether the company is allowed to make such modifications without informing its users in advance.
Jennifer B.
Online platforms can modify their terms of service and privacy policies without advance notice if: (1) Their terms explicitly allow such changes, and (2) Users continue using the platform after changes are made. However, modifications may still be challenged if they are unconscionable or violate privacy laws, particularly if they significantly impact user rights or data protection. While platforms may have the right to make unannounced changes, the enforceability depends on the specific modifications and their compliance with applicable regulations.
