O3 Visa: A General Guide
Jump to Section
The O-3 visa is a non-immigrant visa allowing the spouse and children under the age of 21 of an O-1 or O-2 visa holder to accompany them to the United States. The O-1 and O-2 visas are reserved for individuals with extraordinary abilities in science, arts, education, business, athletics, or other fields and their essential support staff.
Eligibility Criteria for Obtaining an O-3 Visa
To be eligible for applying for an O-3 visa, the applicant must be the spouse or kid of an O-1 or O-2 visa holder. In addition, the O-1 or O-2 visa holder must have already got their visa and be in the United States or applying for their visa simultaneously as the O-3 applicant.
Documents Required to Get an O-3 Visa
The following documents are required to apply for an O-3 visa:
- A valid passport
- A copy of the O-1 or O-2 visa holder's approval notice
- A completed Form DS-160
- Proof of the O-1 or O-2 visa holder's current employment status
- Two passport-sized photos
- Documentation verifying the association between the O-3 visa applicant and the O-1 or O-2 visa holder, such as a marriage certificate or birth certificate
- The visa application fee payment receipt
How to Apply for O3 Visa
The application process for an O-3 visa is similar to that of other non-immigrant visas and is as follows:
- The O-3 applicant must complete Form DS-160 online and pay the visa application cost.
- They must also schedule an interview at a U.S. embassy or consulate in their home nation.
- During the visa interview, the applicant must furnish documentation proving their association with the O-1 or O-2 visa holder, such as a birth certificate or marriage.
Key Terms for O3 Visa
- Spouse: The legally acknowledged partner of an individual in a marriage.
- Non-Immigrant Visa: A visa that allows people to come to the United States temporarily for a specific goal, such as business, tourism, or work.
- Consular Processing: The procedure through which a non-immigrant applies for a visa at a U.S. embassy or consulate abroad.
- Adjustment of Status: A procedure through which a non-immigrant in the United States can apply to become a lawful permanent resident (green card holder).
- Unmarried Children: Kids who are unmarried and under the age of 21.
Final Thoughts on O3 Visa
The O-3 visa is a significant visa category that permits the spouses and kids of O-1 and O-2 visa holders to accompany them to the United States. In addition, the O-1 and O-2 visas are reserved for individuals with extraordinary capability in their respective domains and their essential support staff.
Moreover, the O-3 visa is offered for the same duration as the O-1 or O-2 visa holder's visa and can be extended as long as the O-1, or O-2 visa is valid. While the O-3 visa holder is not permitted to seek employment in the United States, they may engage in other activities, such as participating in cultural affairs or attending university.
