What is a Parental Agreement Form?

A parental agreement form is a legal contract between the parents of a minor child that governs their relationship following a divorce or separation. The parental agreement form includes details regarding how the parents will provide care for their child after the end of their romantic relationship. It covers topics such as transportation, medical care, extracurricular activities, and schooling. By drafting and signing a parental agreement form, the contract parties can better understand their roles and responsibilities to eachother and their child.

The purpose of the parental agreement form is to set the foundation for co-parenting after a relationship is ended.

What's Included in a Parental Agreement Form?

A typical Parental Agreement Form should include the following elements:

  • Identification of the Parties: The agreement should clearly identify the parents, including their full names, addresses, and other relevant information.
  • Identification of the Child: The agreement should clearly identify the child, including the child's full name, date of birth, and any other relevant information.
  • Custody Arrangements: The agreement should specify the terms and conditions for the physical and legal custody of the child, including the schedule for parenting time, decision-making responsibilities, and any restrictions or limitations on the exercise of custody rights.
  • Support Arrangements: The agreement should specify the terms and conditions for child support, including the amount and duration of support, and the method of payment.
  • Communication and Cooperation: The agreement should specify the terms and conditions for communication and cooperation between the parents, including provisions for the exchange of information and the resolution of disputes.
  • Modification and Termination: The agreement should specify the circumstances under which the agreement may be modified or terminated, and the process for doing so.
  • Governing Law: The agreement should specify the governing law that will be used to interpret and enforce the terms of the agreement.
  • Signatures: The agreement should be signed by both parents to indicate their agreement to the terms and conditions outlined in the document.

PARENTAL AGREEMENT FORM

THIS AGREEMENT made on [DATE], between [PARENT 1 NAME], with a mailing address of [PARENT 1 ADDRESS] (hereinafter referred to as "Parent 1"), and [PARENT 2 NAME], with a mailing address of [PARENT 2 ADDRESS] (hereinafter referred to as "Parent 2").

WITNESSETH:

WHEREAS, Parent 1 and Parent 2 are the parents of [CHILD NAME], born on [CHILD DOB]; and

WHEREAS, Parent 1 and Parent 2 desire to enter into this Parental Agreement Form to set forth their respective rights and obligations regarding the care, custody, and support of their child;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

  1. Identification of the Parties. Parent 1 and Parent 2 are identified as the parties to this Agreement.
  2. Identification of the Child. [CHILD NAME] is identified as the child to this Agreement.
  3. Custody Arrangements. Parent 1 shall have [PHYSICAL CUSTODY ARRANGEMENT, SUCH AS PRIMARY PHYSICAL CUSTODY, SHARED PHYSICAL CUSTODY, ETC.]. Parent 2 shall have [LEGAL CUSTODY ARRANGEMENT, SUCH AS PRIMARY LEGAL CUSTODY, SHARED LEGAL CUSTODY, ETC.]. The schedule for parenting time shall be [PARENTING TIME SCHEDULE]. [OPTIONAL: Parent 1 and Parent 2 shall have joint decision-making responsibility for [DECISION-MAKING RESPONSIBILITIES].] [OPTIONAL: Parent 1 and Parent 2 shall not exercise their custody rights in a manner that is detrimental to the best interests of the child.]
  4. Support Arrangements. Parent 1 shall pay child support in the amount of [CHILD SUPPORT AMOUNT] per month, due on the [DUE DATE] of each month. [OPTIONAL: The child support shall continue until [END DATE], or until [OTHER CONDITIONS].]
  5. Communication and Cooperation. Parent 1 and Parent 2 shall communicate and cooperate with each other in all matters relating to the care and welfare of their child. [OPTIONAL: Parent 1 and Parent 2 shall exchange information regarding the child's health, education, and other relevant matters. In the event of a dispute, the parties shall make a good faith effort to resolve the dispute before seeking the intervention of a court or other third party.]
  6. Modification and Termination. This Agreement may be modified or terminated only by written agreement of both Parent 1 and Parent 2, or by order of a court of competent jurisdiction.
  7. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of [STATE].
  8. Signatures. This Agreement shall be executed by both Parent 1 and Parent 2 and shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, and assigns.
