What is a Severance Agreement And General Release?
A severance agreement and general release is an agreement between a company and a departing employee. Employers use these agreements because they can minimize the threat of litigation, guard against the loss of clients or staff, and protect good-will and reputation. The agreement can also provide significant value to the employee, providing for severance payments, continued insurance coverage, and other benefits, such as outplacement services or positive references.
Most of these kinds of agreements concentrate on a severance payment by the employer in exchange for a waiver and release of claims by the employee. These agreements may also contain restrictive covenants like non-compete agreements.
