  3. Submit the Petition. During the annual H1B cap season, usually beginning in April every year, it is important for your employer to timely send their H1-B petition together with other such mandatory USCIS office requirements
  4. Wait for Processing. USCIS will process your application before deciding whether to approve or disapprove it. Such processing may take weeks or, at times, months, depending on how complex matters are.
  5. Attend a Consular Interview. Once approved, go through a consular interview at the U.S embassy/consulate back home carrying correct papers & information about the job profile plus employer, etc.
  6. Obtain Your Visa. If everything goes well during your interview, you will be given an H1B visa that allows you to work for a U.S. employer who sponsored it until it expires.

Note, however, that the number of visas issued under the H1B visa program every year is limited; therefore, ensure that you apply early enough and that all supporting documents are complete and accurate.

Eligibility for H1B Visa

  • You Must Have a Job Offer from the U.S. Employer. The job must be in a special occupation requiring a minimum of a bachelor's degree or equivalent work experience. The employer must file an LCA and attest to paying the prevailing wage for the occupation.
  • You Must Have the Required Education or Work Experience. You must have a bachelor's degree or higher in a related field or equivalent work experience that is considered to be equivalent to a degree.
  • The Job Must Be Related to Your Field of Study or Work Experience. The job needs specialized knowledge about your studies or previous jobs.
  • You Must Have a Valid Job Offer. The job offer must be for full-time employment, and your employer should have enough money to pay you your due salary.
  • You Must Meet the English Language Proficiency Requirements. Functional competency in English (reading, writing, and speaking at a basic level)
  • You Must Have a Valid Passport. Your valid passport should not expire within the next six months from your planned stay period in America.
  • You Must Not Have a Criminal Record. You must be free of any criminal record that would make you ineligible for admission to the US.
