The EB1 categories refer to a set of immigrant visa categories designed for individuals with extraordinary abilities and achievements across several fields. These are mostly the fields of science, arts, education, business, and athletics. The EB1 categories offer a streamlined immigration process for different individuals. The process makes it easier for them to become permanent residents in the U.S. Let us learn more about the EB1 categories and other aspects related to them below.

Steps to Apply for EB1 Categories

The United States has a specific process to apply for either of the EB1 visa categories. The following steps can be followed to apply for an EB1 category designated for individuals with extraordinary abilities and achievements.

  1. Determine Eligibility. Review the specific eligibility criteria for the relevant EB1 category. Decide the category that best suits one’s requirements before going forward with the rest of the process.
  2. Secure a Job Offer. Get an employment offer from a sponsor in the U.S. This is for the job-based categories, which include EB1B and EB1C.
  3. Understand Employer's Role. The employer (or the petitioner, if self-petitioning under EB1A) must file Form I-140 with USCIS.
  4. Gather Documentation. Collect evidence to demonstrate extraordinary abilities or outstanding qualifications. This may include reference letters, awards, publications, and relevant materials.
  5. File Form I-140. Submit Form I-140 to USCIS with the required supporting documents and the applicable filing fee.
  6. Undertake Processing in the USCIS. USCIS reviews Form I-140 and supporting materials, with processing times varying.
  7. Check the Visa Bulletin and Priority Date. Check the Visa Bulletin to monitor visa number availability. Some EB1 categories rely on priority dates.
  8. Apply for Adjustment of Status or Consular Processing. Proceed with adjustment of status if in the U.S. or consular processing if abroad after USCIS approves Form I-140 and visa numbers are available.
  9. Attend an Interview (if required). An interview may be necessary as part of the process, depending on the category and situation.
  10. Wait for a Decision. USCIS decides on adjustment of status or visa application. An immigrant visa or adjustment of status is issued if approved.

Overview of the EB1 Categories

The EB1 visas offer a straightforward path for all immigrants. It helps them become a permanent resident with any labor certification in the U.S. Here is a look at the three main EB1 categories everyone must know for the application process:

  • EB1A: The EB1A category is for individuals with extraordinary abilities in their respective fields. Applicants must provide evidence of sustained national or international acclaim to qualify for this visa. This may include achievements like major awards, an important body of work, published research, or exceptional contributions to their industry. EB1A recipients do not require any kind of job offer. This zero employment option makes it attractive for all the self-petitioners.
  • EB1B: The EB1B category provides a means to get permanent residency for exceptional educators and researchers. Candidates must have a history of excellent work in their academic field for eligibility purposes. Moreover, they need to secure a job offer from a university or research institution too. This classification also needs employer sponsorship, unlike the EB1A category.
  • EB1C: The EB1C category caters to multinational managers and executives. Most of these people want to transfer to a branch, affiliate, or subsidiary of their current employer in the U.S. Eligible applicants must have spent at least one of the past three years working for the same international employer. This category requires employer sponsorship. It further offers a path to permanent residency for all experienced corporate leaders.

I am available to advise on entity formation, contracts, and employment policies. I am also comfortable litigating business disputes including partnership disputes and employment cases. Prior to opening my current practice, I worked for several years in a small civil litigation practice focused on employment matters and civil litigation. I attended law school at the University of Colorado, and I went to the University of British Columbia for my undergraduate education.

Most of my career has been as in-house counsel for technology companies. My responsibilities included managing all vendor/procurement contracts and compliance, customer/partner/reseller contracts and compliance, data security/privacy compliance and incident responses, HR/employment issues, and legal operations. I am very comfortable negotiating Commercial Contracts, Vendor Agreements, and Procurement Contracts for goods, services, and licensing, as well as addressing Employment & Labor, Intellectual Property, and Data Privacy issues and compliance. I specialized and have a certificate in IP in law school and continued to develop in that area as in-house counsel for Interactive Intelligence, Genesys, which are unified communication companies, and KAR Global in the automobile digital services lines of business.
