  4. Gather Documentation. Collect evidence to demonstrate extraordinary abilities or outstanding qualifications. This may include reference letters, awards, publications, and relevant materials.
  5. File Form I-140. Submit Form I-140 to USCIS with the required supporting documents and the applicable filing fee.
  6. Undertake Processing in the USCIS. USCIS reviews Form I-140 and supporting materials, with processing times varying.
  7. Check the Visa Bulletin and Priority Date. Check the Visa Bulletin to monitor visa number availability. Some EB1 categories rely on priority dates.
  8. Apply for Adjustment of Status or Consular Processing. Proceed with adjustment of status if in the U.S. or consular processing if abroad after USCIS approves Form I-140 and visa numbers are available.
  9. Attend an Interview (if required). An interview may be necessary as part of the process, depending on the category and situation.
  10. Wait for a Decision. USCIS decides on adjustment of status or visa application. An immigrant visa or adjustment of status is issued if approved.
