What is a Guaranty Agreement Review?

A guaranty agreement is a legal contract that specifies how a guarantor will take the responsibility for a borrower’s financial responsibilities should the borrower default on their payments.

What are Terms to Review in a Guaranty Agreement?

  • Defaults. It must be clear what constitutes a default and if the creditor should pursue the primary obliger before demanding payment.

How Do You Review a Guaranty Agreement?

To ensure all provisions are clear in the guaranty agreement, there are some details to review carefully.

Consider if the Debt is a Loan

If the debt being paid is a loan, it’s important for the guaranty agreement to include details about the original loan, such as its effective date and a description of the loan. This ensures that all payment obligations are clear.

Think About Financial Obligations
