Eligibility Requirements of the P3 Visa

The P3 visa is a temporary work visa designed for artists and entertainers seeking to perform in the United States for a specific event or series of events. This visa is specifically for those coming to the US to participate in a cultural exchange program, which includes sharing their home country's traditions, history, and cultural heritage with the US audience.

To be eligible for the P3 visa, you must meet the following criteria:

  • Cultural Exchange

  • Qualifying Performance
Your performance must be culturally unique, traditional, or artistic. It must also be a non-commercial performance or a commercial performance that has been produced or developed by a US-based employer or organization.
  • Skills and Experience
You must possess the skills, knowledge, and experience necessary to perform in the program or event you are applying for the P3 visa.

  • Form I-129

This is the Petition for Nonimmigrant Worker form that your sponsoring organization must file. This form will be submitted to the US Citizenship and Immigration Services (USCIS).

  • Support Letter

Your sponsoring organization must provide a support letter outlining the details of your cultural program or event and confirming that you are being invited to participate.

  • Evidence of Cultural Exchange

Key Terms for the P3 Visa Application

  • P3 Visa: A visa that allows foreign artists or entertainers to enter the US to perform, teach, or coach in a cultural program.
  • Culturally Unique: Programs must showcase a traditional, ethnic, folk, cultural, musical, theatrical, or artistic performance or presentation.
  • Agents: A US-based agent must act as a petitioner and be authorized to represent the sponsoring organization and the beneficiary (artist/entertainer).
  • Essential Support Personnel: Individuals who are an integral part of the performance, such as stagehands, lighting technicians, and sound engineers, can also apply for a P3 visa.
  • Advisory Opinion: A written advisory opinion from a recognized organization in the field of the beneficiary's endeavor must support the cultural authenticity of the program.

Final Thoughts on the P3 Visa Application

When applying for a P3 visa, it's essential to provide clear and comprehensive documentation showcasing the program's cultural significance, the artist or entertainer's qualifications, and the essential support personnel's role in the performance. Working with a qualified immigration attorney or agent can help ensure that your application meets all the requirements and has the best chance of success. Good luck with your P3 visa application!

I am the Managing Partner of Adams Global Immigration, a Business Immigration Law firm focusing on nonimmigrant visa processing (H-1B, L-1, E-2, E-3, O-1, TN, etc.) and immigrant visa processing (EB-1, EB-2, EB-3, PERM, NIW, etc.). I have many years of business immigration experience, including legal work at Jackson and Hertogs, Fragomen, E&M Mayock, and as a Freelance Immigration Specialist. My specialization includes complicated Request for Evidence responses and high-volume nonimmigrant visa preparation. I can provide legal advice regarding employment visa preparation, unique international travel issues, and various other complex immigration matters. Prior to joining Jackson & Hertogs in 2018, I served as a Certified Law Clerk with the San Diego Public Defender office through Thomas Jefferson School of Law (TJSL). In this role, I argued over 40 hearings in state court for criminal juvenile matters, adult misdemeanors, and adult felonies. I subsequently joined the TJSL Removal Defense clinic, wherein I argued and won a full asylum trial in Federal Court for a Moroccan refugee fleeing severe LGBTQ persecution.
