Help with refund for dog purchase from breeder.
I purchased an older dog 8m from a breeder who was sold to me as being kennel trained and brought to me in poor condition. This dog has had severe separation anxiety and definitely isn’t kennel trained. I have been in contact with the breeder about returning this dog. She is stating she will give me a credit of 1500$. I bought her form $2500 plus spent $1250 in training and she is still having severe issues.
I would like a full refund at the least or a full refund of the 2500$ plus the cost of training.
I need to return this dog to the breeder Friday the 28th so need a fast turn around.
I was supplied a contract that I did not sign. I do not want a credit with this breeder as I have not had a good experience.
Hello! My name is Dolan and thank you so much for contacting me! I just had a few quick questions for you: What state did you buy the dog in? Did you get a warranty on your dog?
Utah. The contract that I didn’t sign states that I get a credit less $500 towards another dog. I am asking for a full refund as I don’t want to purchase another dog from her.
I am having trouble uploading the contract in this app. Do you have an email I could send to you
Got it - I'd definitely call, but I'm just in a meeting right now and I'm so sorry. So here is what you need to do: 1. It looks like you have a cause of action for a breach of the implied warranties of fitness and merchantability and even fraud; 2. This means you should push back hard on the breeder and make it clear that a credit isn’t acceptable. Since you never agreed to the terms in the contract, you’re not bound by them. Let the breeder know in no uncertain terms that you were sold a dog under false pretenses in this case; 3. If that doesn’t work, you can consider filing a complaint with the Utah Department of Commerce’s Consumer Protection Division. 4. A complaint with the FTC can be filed starting here - https://consumer.ftc.gov/media/video-0054-how-file-complaint-federal-trade-commission 5. Another step you can take is disputing the charge with your credit card company if you paid with a card. Many credit card companies allow disputes for misrepresented goods or services, and since you received a dog that was not in the condition promised, you might have a case for getting your money back through a chargeback. 6. Lastly, if the breeder still won’t budge, you could take legal action. Small claims court in Utah allows you to sue for up to $15,000, and since you’re asking for less than that, it could be a viable option.
Are you able to write something up for to her?
So I couldn't do that specifically, BUT what you could do is buy a template (they're pretty cheap) and I can offer some very good suggestions for wording - https://www.contractscounsel.com/t/document-form-checkout/256
