Hello, what is the turn around time for responses?
Hello! My name is Dolan and thank you so much for contacting me! I just had a few quick questions for you: What reasons do you think you may have been sued?
Hello, am I being sued? How can this be verified, and what is it regarding?
Understood - so on the document, it may say that you have a "summons" A summons is a set of instructions from the court and will have a court's stamp or a court clerk's signature on it as well as a case number listed on it.
Now, if it says they are just "attempting" this, it means you haven't been served. The law requires you be served in person. So this means that you should consider calling whatever number they left and then asking them what it is they are trying to serve. It could be for any number of things, such as a subpoena to be a witness in some case, it could be because you've been sued for some reason, or it could just be a mistake. It's hard to know for sure, but what you can just do is investigate with the information they left. Does that help clarify things? I want to make sure I didn’t leave anything out.
Thank you for this information. When I call, what information should I give?
Also, I have a couple of debts in collection. Could this be the reason? Should I reach out to my creditors?
Sure thing! You're welcome. Usually, for things like this, it's typically debts. If you cannot think of any other reason why a person would sue you (e.g. a car accident, some physical injury, dog bite, etc.) then it's almost always going to be debts. It's entirely possible it's just a mistake. You can also call or go online to check your local courthouse records and you can see if your name shows up because they would have already filed if they are serving you.
Hi Dolan, thank you for this information/ advice. I contact the debt collector. Please find attached the agreement. What do you recommend?
Hello! I can review documents with a 10% discount, but the site limits me on being able to just review these documents as a part of the chat. The reason is just that reviewing documents requires more time and attention beyond just general answers in chat. My recommendation is to post a job to the contractscounsel.com site in this case and ask for a Maryland lawyer specifically.
I understand. The debt collector offered a payment arrangement, in exchange for dismissing the case. What would you recommend?
Ok got it - in my experience, yes. The main reason is you want to avoid litigation and if they get a judgment, they could do things like freeze your bank account or garnish your wages and it can be a real headache.
Thank you!
