How do I determine acceptance of an offer from a breach of contract
Hello, I need to speak with a lawyer about contract law
Hello! My name is Dolan and thank you so much for contacting me! I just had a few quick questions for you: If I can clarify, is someone alleging you breached the contract?
I have sent this message in another window so I don't know if putting it here will work. We had a question for my solar company as to why we were still getting electricity bills. We were told that we were incorrectly informed about the power usage and absorption. He stated that they don't work with Entergy Electric company and that they thought we were with Centerpoint Electric. We were further informed that we no longer had to pay the solar bill and we would own in but not be able to receive the tax credit. They would receive the tax credit. We were also informed that we would need to pay the electricity bill with Entergy. I'm concerned about the legitimacy of it all and if it is a good deal and would like someone to look over the contract and give advice
Got it - did they ever collect any of your previous solar usage at all? Did they have any data to back up what they said?
We made solar payments through a subcontractor (Everbrite then switched to Goodleap) The program was just recently activated. It took a long time. We have been paying both the Electricity company and the solar company. I don't know if any energy has been collected to this point. it has been an unusual journey.
Ok got it! What did your solar provider suggest was the cause for this increased bill? Did they just say they thought you were with a different electric company?
They stated the the previous employed person that sold the program, miscalculated and quoted us incorrectly. He also stated the they were under the assumption that we were with Centerpoint but later found out that we were with Entergy, a company that they have difficulties working with. I really just want the comfort of knowing that we are not getting into a huge problem. The panels are on our roof.
Ok! Did you need to tell me anything else? If not, I can start with answering your question.
Only that I would like the contract read over that consists of 25 pages
Sure thing! So when it comes to contract reviews, those are more in-depth and 25 pages may take about an an hour or more to review and analyze the document which would be a little bit beyond the chat, BUT you get: 1. 10% our regular fees (so it'd be a total of $*** down from $***); 2. I would review it within one business day; and 3. I can still chat with you here. Just let me know and I can create a job for you. Thanks!
I really just wanted advice and to know what it is that I am reading. I cant afford the price for that service. thank You
Please don't worry. *You bet! I'll be with you ASAP!
I'm so sorry about this situation! I want to address your situation with a detailed response, so if you have any questions, don’t hesitate to ask because this law stuff can get complicated. Ok so in your case, what you have is negligent misrepresentation. This occurs when someone should have investigated more before making statements that led you to buy. This means if they failed to properly ascertain your energy usage to determine not only how many panels you may need, but also to determine the expected solar output needed, the company is liable for the representations. You may want to consider just writing a formal demand letter. https://www.contractscounsel.com/t/document-form-checkout/256 You should demand that they put on a new panel without any additional charge in this case and that they pay for the value of your last true-up bill as well!
Thank You for the information. I appreciate it.
For sure! Were there any details I missed? Were there any concerns you still needed to be addressed?
No. Thank you very much
