How do I lease a commercial space and be legally protected? Hey I recently purchased a small retail building, and I’m planning to lease it out. This is my first time being a landlord, so I want to make sure the lease agreement protects me legally and minimizes my risks. What do I need to include in the lease, and how do I handle things like tenant disputes or damages?

Hello, and thank you for your question! My name is Dolan, and I’d be happy to help with this. I carefully review each question and provide responses based on my years of hands-on experience as a lawyer. Drafting a commercial lease that protects your interests is essential for avoiding disputes and ensuring a smooth landlord-tenant relationship. Here are the key elements to focus on:
1. Clear Lease Terms: Define the rent amount, due date, and any late fees. Include provisions for rent escalation, if applicable.
2. Tenant Responsibilities: Specify who handles repairs, maintenance, and utility costs.
3. Use of Property: Outline what activities are allowed and prohibited on the premises.
4. Security Deposit: Detail the amount, conditions for withholding, and return procedures.
5. Insurance Requirements: Require tenants to carry liability insurance and name you as an additional insured.
6. Default and Remedies: Specify the steps...

Negotiating a commercial lease can be a challenge, but with the right strategy, it’s often possible to secure more favorable terms. To provide you with the best advice, I’ll need a bit more information:
1. How much is the landlord proposing to increase the rent, and how does it compare to what you’re currently paying?
2. Are there any additional lease terms you’re looking to negotiate, such as the length of the lease or maintenance responsibilities?
3. Have you had any prior discussions with the landlord about your concerns?
With this context, I can guide you on strategies for negotiation and ensure you approach this in the most effective way.

I need to evict a tenant from a commercial space I own. How can I do that? Hey I have a commercial building and lease it to retail tenants. One of my tenants has not paid rent in 3 months and I want to get rid of them. What type of process can I use to get them out of the unit? Can I evict them? Possible for to just lock the doors or do I need to do something in court?

Evicting a commercial tenant is a legal process, and changing the locks without following proper procedures can lead to serious legal consequences. Typically, the eviction process involves the following steps:
1. Review the Lease Agreement: Look for clauses that outline remedies for non-payment of rent or tenant defaults.
2. Serve a Written Notice: Most states require landlords to serve a formal notice (e.g., a “Notice to Pay Rent or Quit”) before starting eviction proceedings. This notice usually gives the tenant a set number of days to pay rent or vacate.
3. File an Unlawful Detainer Action: If the tenant doesn’t comply with the notice, you’ll need to file a lawsuit in court to regain possession of the property.
4. Court Process: The court will set a hearing d...

How much for lawyer to review my commercial lease agreement? Hey I am going to sign a commercial lease agreement for a new coffee shop we are opening. The document is 25 pages in length and we want it reviewed to make sure we do not miss any important terms. How much will it cost me to review this lease?

Hello ****, and thank you for your question! My name is Dolan, and I’d be happy to help with this. I carefully review each question and provide responses based on my years of hands-on experience as a lawyer.
Reviewing a commercial lease is a good step to protect yourself and your business. These agreements often include complex terms that can significantly impact your operations. For a 25-page lease, my fee would be $***for a detailed review, which includes:
1. Identification of Key Clauses: Highlighting critical terms like rent, escalation clauses, and additional fees (e.g., common area maintenance).
2. Advice on Negotiation Points: Suggesting areas where you might want to negotiate for more favorable terms.
3. Customized Feedback: Addressing specific concerns you may have about the lease.
Before we dive in, can you share a bit more about the lease? For instance:
1. Does the lease specify who is responsible for maintenance and repairs...

Getting out of a commercial lease if needed. About to sign new commercial lease. I have a new business I am opening. It is a boutique shop and just received a commercial lease agreement. It is a lot of money, so am just a bit nervous. I want to understand what the lease means as it relates to our ability to get out if the business doesn't go well. Make sense?

A commercial lease is a commitment to a lot of money. Congrats on starting a new business. Let me ask a couple more questions so I get a better sense of the situation. 1. Are there any early termination or subletting clauses in the lease? 2. Do you have any concerns about the lease (or landlord) specifically?? 3. How long will the lease be for? What do the renewal options look like? Let me know what you can share, and I’ll walk you through some simple strategies to help you negotiate favorable terms.

Hi. My landlord is not living up to the terms in our lease agreement. He keeps coming into our apartment unannounced and also hasn't taken care of some pretty routine things we've requested months ago. Our lease agreement says he needs to give us a heads up when he wants to enter the premise. It also says he is responsible for certain maintenance of the apartment- which he hasn't been helping with. I am not a lawyer so not sure if I am interpreting the language of the lease correctly.

Hello! Thank you so much for asking this question. I'm happy to help. I just had a few questions: 1. Can you clarify what specific notice period your lease agreement requires before the landlord enters the apartment? 2. Have you made any formal, written maintenance requests to your landlord, and if so, what was the response?

I received a commercial lease agreement for a fitness studio. What are the terms I need to be aware of? This is my first time dealing with a lease agreement. Any pointers you can provide would be greatly appreciated. I'm also happy to copy and paste some of the clauses here if that is helpful.

Hello ***! Thanks so much for coming to contractscounsel.com. So in my experience, there are specific things you must pay attention to: 1. The first is rent and expenses. I always recommend that parties pay very close attention to the rent amount, how it's calculated (e.g., per square foot), and whether it increases over time (e.g., annual escalations). For commercial leases, issues like repairs and upgrades are flexible unlike in residential tenancy agreements. So what this means is that you should clarify what expenses you're responsible for. For example, many tenants are responsible for property taxes, insurance, maintenance, and utilities. 2. The second is concerning the terms and the renewal. Consider whether the term aligns with your business plan and if there are options to renew. Renewal options may come with predefined rent increases or require negotiations.

can I terminate a commercial lease easily without any sort of penalty? My business is tanking right now and have a small shop that I’ve been renting for 2 years. It is a retail shop. I signed a 5 year lease so there are 3 years left. I want to learn if there is a way I can get out of this without any sort of penalties (or minimal penalties) or any legal trouble. Is this something you can help me with?

Hello, and thank you for your question! My name is Dolan, and I’d be happy to help with this. I carefully review each question and provide responses based on my years of hands-on experience as a lawyer. Getting out of your lease is going to depend on the terms in the agreement you signed. I have a few questions for you so I can get a better picture of the situation. 1. Do you know if the lease has a termination clause ("break clause")? 2. Have you had any trouble with the landlord and/or property? (unaddressed maintenance, safety)? 3. Have you chatted with the landlord about this? Once I get this info, I will have better options for you. Let me know when you can.
