How can I enforce my Right of First Refusal? In [REDACTED], my family members and I entered into a Right of First Refusal (ROFR) Contract with [REDACTED] regarding the sale of family's homesteaded land in [REDACTED], Oklahoma. The reason we included this ROFR was because we agreed to sell the land to [REDACTED] at a discounted price ($700 per acre), under the condition that if he later decided to sell, he would first offer it back to family members at either $700 per acre or fair market value, whichever is lower for the *** acers of land. On [REDACTED], I received correspondence from [REDACTED] attorney, [REDACTED], claiming the ROFR contract is unenforceable due to an alleged lack of consideration. The attorney requested all family members sign waivers relinquishing any rights under this agreement by [REDACTED], or they intend to file legal action. I strongly disagree with their assertion. The discounted sale itself clearly represents valid consideration, and multiple email communications from [REDACTED] demonstrate clear intent, mutual understanding, and explicit acknowledgment by [REDACTED] himself regarding the conditions of our agreement. He has been offered above $1400 an acre and is trying to sell it to a third party. Immediate questions I have for you: Should we formally respond to [REDACTED] attorney prior to [REDCATED], explicitly rejecting their claims and formally exercising my right under the contract? Would filing a Lis Pendens or other notice in [REDACTED] be advisable to protect my rights and prevent the sale to a third party pending resolution? Are there any immediate actions you recommend before the opposing attorney’s stated deadline?

Can two contracts for deed exist on the same property? A man (*******) owns a property outright and has Deed. For 10 years . In 2021 he sold the house for $**k under a CFD to *******- ******* has been paying $***/ mo and still owes $**k on house to gain clear title - CFD is filed in local courthouse showing both ******* and ******* as joint title holders. There are 10 yrs 8 mos left on the mortgage payments with a clause to forbid early payoff. ******* now wants to sell the home under CFD to our son ***** for $***K under no interest payments for 10yrs 8 mos to where all contracts are paid off at same time and Deed/title are transferred at same time. Questions: Is it allowable to have two contracts for Deed on same property? If something happens to *******, how can ***** obtain property without paying off both mortgages to get it ?

Am I required to pay under lease agreement? If my lease states "Tenant shall, at Tenant's sole cost and expense, maintain the Leased Premises in a clean, neat and sanitary condition and shall keep the Leased Premises and every, part thereof in good condition and repair except where the same is required to be done by Landlord." and then "Tenant may perform all maintenance to the interior and exterior of the Leased Premises and keep the same in good operating condition and repair, including, but not limited to, maintaining, repairing and replacing, if necessary, the roof..." does this mean that I, as the tenant am required to pay for a roof re-sealing? "Shall" in the first sentence, and then "may" in the next is causing some confusion and before I pay for a roof reseal on a building I don't own, I was looking for some clarification. Thank you I am in Arizona, if that matters. Thanks.
