What is a demand letter?
I recently received a letter from a collection agency demanding payment for an outstanding debt. I am unsure if this is a demand letter, or if there is a different type of letter I should be expecting. I am looking for clarification on what a demand letter is so that I can better understand the situation and take the appropriate steps to resolve this debt.

What you are describing certainly sounds like a demand letter. A demand letter is simply a demand for payment of money or damages you are claimed to owe in exchange for avoiding legal action. I strongly recommend you consult with an experienced GA litigation attorney, such as myself, before deciding on your next steps.

I have a promissory note written in Montana that was breached. I am in New York. I am the borrower and my aunt is the lender; I have since discovered she wrote the note with unfair terms. I need the note voided. What do I do? I can’t find an attorney anywhere to take my case.

Hello, The answer to your question will depend on what your contract has stated as the law that will govern your contract. Somewhere in your agreement should be the words "this contracts is governed by the law of _____". If your contract says Montana, then you will need a Montana attorney. If the contract says New York, then you will need a New York attorney

What's the termination clause in an employment contract?
I recently accepted a position at a company and they have given me an employment contract to review. I have been reading through the contract and noticed a section regarding termination. However, I am not sure what the termination clause in the contract states and I am hoping to get some clarification from a lawyer. I want to make sure that I understand my rights and obligations before signing the contract.

What is the maximum that can be sued for in TX small claims from a commercial landlord withholding security deposit in bad faith?
I recently relocated my office and the old locations’ landlord is withholding my security deposit in bad faith, no itemized deductions for any claimed repairs, and no supporting documentation for anything reasons they are using to hold my deposit. I would like to send a demand letter to them and then prepare for small claims. I just have a question on how much i am allowed to sue for. I heard it is something like 3x of the amount, plus all other reasonable fees. Would like some counsel here.

Justice Courts have jurisdiction of civil matters in which the amount in controversy is no more than $20,000 (or $10,000 if the case was filed prior to September 1, 2020), exclusive of interest and court costs, but including attorney fees, if any. I presume someone has mentioned to you theories of treble damages recoverable under the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA) for knowing and intentional deceptive acts. While the DTPA is a broad, ranging statute, it cannot convert what appears a purely a breach of contract claim into a DTPA claim (in most instances) absent an separate act by the landlord. You should consult a contracts / DTPA lawyer who can help you evaluate the viability of your claims. Start with your lease agreement. Hope this helps. Kelvin www.roqski.com
